About this file

This document provides clarifications to Amendment 004 of solicitation 140FC124R0002 issued by the Department of the Interior Fish and Wildlife Service. The solicitation is for the design and construction of a new 5,000 square foot office building and visitor center at Long Lake in North Dakota. Amendment 004 removes experience with structural insulated sandwich panels and past performance related to panels from the technical evaluation factors. It also removes the requirement for a civil engineer. The clarifications specify that to be considered for award, offerors must provide the minimum two relevant project references requested under Factor 1, where the offeror served as prime contractor on similar size and scope commercial buildings. The basis for award will be a tradeoff between technical capability, experience, past performance, and cost/price as outlined in the solicitation. Offer and performance bonds are governed by FAR provisions 52.228-1 and 52.228-15 respectively, as defined in the base solicitation.

Clarificaons Amendment 004

1. What/how is a federal agency contract determined for a relevant prime contractor experience? What does FWS require to determine and define these contracts?

1. Factor 1 – Recent Relevant Experience: Amendment 003 Evaluation Technical Factors attachment states “Offerors shall provide the minimum requested project information on at least two (2) relevant projects completed within the last (5) years for the construction of similar projects as stated on Specifications.” The specification defines what the current project is, and relevance is “the contractor shall have experience with construction of commercial buildings similar or exceeding size and scope (Scope meaning the scope of this project)...” FWS requires that in order to be considered for award, offerors must provide the requested price and technical factors.

2. Factor 1 also states “for a project to be considered, the offeror shall have been the prime contractor on it.” This statement is included to indicate that the Prime contractor submitting on offer for this requirement has experience as a prime contractor on other similar type building projects.

3. The basis of Award is Tradeoffs in accordance with FAR 15.101-1 and section M.1.0 of the base solicitation, “where technical capability, experience, and past performance, when combined are approximately equal to cost/price.” Section L provides Instructions, conditions, and notices to bidders, Section M provides the basis of award (Amendment 003 revises the technical factors to remove the SIPS panels experience and SIPS panels past performance, and removes the requirement for a Civil Engineer). Amendment 003 does not outside of the stated changes, change/impact the base solicitation.

2. What are offer guarantee and performance bond terms?

1. The Offer or Bid Guarantee is defined at FAR 52.228-1 of the base solicitation.

2. Performance and Payment Bonds are defined at 52.228-15 of the base solicitation.
