About this file

This document contains questions and answers regarding solicitation number 140F0120R0019 for a design-build project to construct a new stream channel at the Moapa Valley National Wildlife Refuge in Nevada. The U.S. Fish and Wildlife Service originally required offerors to submit 20% schematic design documents with Phase 1 proposals but has since removed this requirement due to concerns about cost and lack of reimbursement. Offerors now have the option to submit initial drawings and specifications with Phase 1 proposals to assist with developing their Phase 2 price proposals, if selected to advance. The deadline for questions was extended to August 10th to match the new Phase 1 proposal due date of August 20th. The contractor will be responsible for performing and submitting a jurisdictional delineation of the stream and culvert location to the U.S. Army Corps of Engineers.

RFI Questions and Responses Yellow Highlighted Cells are Amendment No. X Questions and Responses Added.

No. Question and/or Notes Response Date of Posting

1 1. L.2.1..1 Technical Capability and L.2.1.2 Past Performance-no questions for clarification. If there are any follow-up questions on this section, please let us know.

17-Jul-20 L.2.1.3- Evaluation Factor 3; Technical Approach: States we are to provide 20% Schematic Design Documents. We are looking at an outlay cost for 20% drawings.

20% drawings typically are part of a Design/Build contract- Does the USFWS want 20% drawings at the cost of the contractor without any consideration for the drawings? If I am interpreting Section L correctly, this is a 2 part process requesting substantial initial work on the project itself with no guarantee of being able to actually be called upon to provide a price. Please confirm that is the intent of the solicitation.

The USFWS has decided to revise the Evaluation Factor 3. The requirement for Initial 20% Schematic Design Documents is deleted.

Refer to Revised Section L and M and Strikethroughs.

The 20% drawing requirement was determined to be overly burdensome and there is no mechanism In-Place to reimburse proposal costs for this item. The orginal purpose of the Initial 20% Drawings was to serve as an Evaluation Item in Phase 1 and Firm Up the Basis of a Price Proposal if the Contrator was selected for Phase 2.

You are correct, this is a two (2) Part Process and only Contractors selected in Phase 1 will be advanced to Phase 2 Evaluation and only one (1) contractor will be selected for Contract Award at the conclusion of Phase 2.

In addition to the Strikethrough, the following was inserted into Factor 3:

The Contractor also may present initial Drawings and Specifications for Evaluation in Phase 1 and to assist with establishing the Bid Proposal in Phase 2. Whether the Contractor decides to present initial Drawings and Specifications in Phase 1 is at the discretion of the Design-Build Contractor. If the Contractor decides to present Initial Drawings and Specifications there will be no page limitation or maximum number of pages...Lastly, the Construction Prime Contractor and their Team shall explain how current project solicitation attachments will be developed to meet project outcomes and what conditions and/or assumptions were established. 17-Jul-20

Do the drawings then become the property of the USFWS, should the contractor not be moved into Phase 2 and/or awarded the project?

Refer to above response. If the Contractor decides to present initial Drawings and Specifications in Phase I and the Contractor is not selected to advance to Phase 2 and/or is not awarded the Project, the USFWS would reserve the right to use the ideas and/or concepts shown in those drawings and own those drawings. 17-Jul-20

Section L2.1.3. of the Instructions indicates a maximum of 5 pages allowed for the 20% Schematic Design Documents.

Q: Are 11x17 sheets (or other sizes larger than 8.5x11) allowed with the submittal for the drawings?

You may use 11 x 17 or 22 x 34 Electronic Size Drawing Pages.

Please note, under Amendment 2, the Initial 20% Schematic Design Drawings are now an Optional Submittal now referred to as "Initial Drawings and Specifications.

The Page limitation for Initial Drawings and Specifications was elminated.

Refer to Question No. 2 (Amendment No. 2) response above. You may use unlimited number of Pages for Drawings and Specifications and at the discretion of the Contractor. 28-Jul-20

Section L.1.3. States that all questions regarding the solicitation must be submitted by 7/31. Amendment one extended the due date for the Phase 1 submittal from 8/10 to 8/20.

Q: Will the deadline for questions be similarly extended 10 days?

The due date for questions will be extended by 10 days to 8/10/2020.

28-Jul-20

6 Is there a jurisdictional delineation for the stream and the culvert location?

There was no jurisdictional delineation for the stream and culvert performed prior to advertising this project.

The awardee Design-Build Contractor shall develop, prepare, and submit a Jurisdictional Delineation (includes on-site survey and follow-up report) for USFWS to USACE for verification. Either a Final Approved Delineation or a Verified Preliminary Delineation shall be submitted with the Permit Applications for Section 401 and Section 404.

From the Statement of Work, Contractor is in charge of submitting Permit Applications, Supporting Documents for those applications, paying all associated fees, obtaining Permit Approval / Conditional Approval, and securing an approved copy of the permits. TBD.
