About this file
This document contains responses to questions from contractors on a request for information (RFI) related to a design-build contract opportunity for a new stream channel at the Moapa Valley National Wildlife Refuge in Nevada. The contract is a two-phase solicitation process, with only contractors selected in phase one advancing to phase two for final evaluation and award. The requirement for initial 20% schematic design drawings in phase one has been removed as overly burdensome, though contractors can optionally provide initial drawings and specifications for evaluation purposes to help establish their phase two price proposal, with no page limits or maximums. If a contractor provides such initial drawings and declines to advance to phase two or is not ultimately awarded the contract, the Fish and Wildlife Service would reserve the right to use concepts from the drawings but would own the drawings.

RFI Questions and Responses
No. Question and/or Notes Response
1 1. L.2.1..1 Technical Capability and L.2.1.2 Past Performance-no questions for clarification. If there are any follow-up questions on this section, please let us know.
L.2.1.3- Evaluation Factor 3; Technical Approach: States we are to provide 20% Schematic Design Documents. We are looking at an outlay cost for 20% drawings.
20% drawings typically are part of a Design/Build contract- Does the USFWS want 20% drawings at the cost of the contractor without any consideration for the drawings? If I am interpreting Section L correctly, this is a 2 part process requesting substantial initial work on the project itself with no guarantee of being able to actually be called upon to provide a price. Please confirm that is the intent of the solicitation.
The USFWS has decided to revise the Evaluation Factor 3. The requirement for Initial 20% Schematic Design Documents is deleted.
Refer to Revised Section L and M and Strikethroughs.
The 20% drawing requirement was determined to be overly burdensome and there is no mechanism In-Place to reimburse proposal costs for this item. The orginal purpose of the Initial 20% Drawings was to serve as an Evaluation Item in Phase 1 and Firm Up the Basis of a Price Proposal if the Contrator was selected for Phase 2.
You are correct, this is a two (2) Part Process and only Contractors selected in Phase 1 will be advanced to Phase 2 Evaluation and only one (1) contractor will be selected for Contract Award at the conclusion of Phase 2.
In addition to the Strikethrough, the following was inserted into Factor 3:
The Contractor also may present initial Drawings and Specifications for Evaluation in Phase 1 and to assist with establishing the Bid Proposal in Phase 2. Whether the Contractor decides to present initial Drawings and Specifications in Phase 1 is at the discretion of the Design-Build Contractor. If the Contractor decides to present Initial Drawings and Specifications there will be no page limitation or maximum number of pages...Lastly, the Construction Prime Contractor and their Team shall explain how current project solicitation attachments will be developed to meet project outcomes and what conditions and/or assumptions were established.
Do the drawings then become the property of the USFWS, should the contractor not be moved into Phase 2 and/or awarded the project?
Refer to above response. If the Contractor decides to present initial Drawings and Specifications in Phase I and the Contractor is not selected to advance to Phase 2 and/or is not awarded the Project, the USFWS would reserve the right to use the ideas and/or concepts shown in those drawings and own those drawings.
