About this file
This is a Question and Answer document for Federal Acquisition Regulation (FAR) Solicitation 140D0426Q0514 for the installation of a fence at the Museum of the Plains Indian, issued July 7, 2026.
The document addresses five substantive areas of inquiry. Regarding gate specifications, the government confirmed that the double drive gate location may be repositioned 24 feet inward from the original location without requiring additional fence sections, and that pedestrian walk gates may be reduced from 10-foot to 6-foot width per updated Attachment 3. For post installation, the government approved concrete footings installed in accordance with manufacturer requirements as preferable to the originally specified digging and backfill method, citing the need for stability in windy conditions and heavy snow. Post hole inspection requirements were clarified to mandate government inspection of all posts before installation, with contractors required to provide advance notification. Regarding Blackfeet Tribal Employment Rights Office (TERO) compliance for projects exceeding $100,000, the government confirmed that both the 4% TERO fee and 3% Blackfeet Tribal Excise Tax apply to this project. Both prime contractors and subcontractors must obtain tribal business licenses and TERO work permits, with all associated costs to be included in the proposed price. The government noted that a compliance plan must be completed and submitted with permit applications, and that the awarded contractor will receive a government point of contact to coordinate the compliance process.

140D0426Q0514 – Museum of the Plains Indian – Installation of Fence
Question and Answer
July 7, 2026
1. Question pertaining to the Double Drive Gate Location - For one of the 30-foot double drive gates, Museum personnel indicated a preference to move the gate inward toward the building. Please confirm whether the gate location may be shifted and whether approximately 12 feet of fence may be added on each side to accommodate the revised location.
Answer: The current measurement on the map for a 24 feet inward gate location is sufficient.
We do not need an additional 12 feet.
2. Question on the Pedestrian Walk Gate Width Please confirm whether the pedestrian walk gates may be changed from 10-foot gates to 6-foot gates if the Museum determines that 10-foot pedestrian gates are not needed.
Answer: See updated Attachment 3.
3. Question on the Post Installation Method The specifications reference digging the posts and backfilling/compacting. Please confirm whether concrete footings around the posts would be acceptable if installed in accordance with the manufacturer’s requirements.
Answer: Yes, concrete footings would be ideal to assure stability in our windy conditions and winter snow amounts.
4. Question on Post Hole Inspection Requirement The specifications state that the contractor must notify the Government before setting posts for inspection. Please confirm whether inspection of post holes is required for all posts, selected posts, or only when specifically requested by the Government representative.
Answer: The government will inspect all posts. See updated Attachment 1.
5. Questions on Tribal Permits through the Blackfeet Tribal Employment Rights Office (TERO) requirements
• Does the 4% TERO fee apply to this project?
• Does the 3% Blackfeet Tribal Excise Tax apply to this project?
• Is the required Tribal Business Licenses to be obtained by the prime contractor, the subvcontactor performing the installation work, or both?
• Are the required TERO work permits to be obtained by the prime contractor or subcontractor performing the work?
• If applicable, should the costs associated with these requirements be included in the contractor’s proposed price?
Answer:
• Yes, it is required for projects over $100,000.00.
• Yes.
• Both the contractor and subcontractor are required to have a tribal business license.
• Both the contractor and subcontractor are required to have a TERO work permit.
• Yes
Additional note: As part of obtaining the necessary permits, there will need to be a compliance plan that will be required to be completed and submitted with the application. Once the compliance plan is in place, the permits will be printed. The contractor can work with the Government point of contact, which will be provided with the award, to coordinate the compliance plan and applications for the licenses and permit.
