FAR 52.212-1 Instructions to Offerors—Commercial Products and Commercial Services (Mar 2023) Addendum
The prospective vendor shall assume the government “has no prior knowledge” of its capabilities and experience and will base its evaluation on the information presented in each quote. Simply stating that you will perform in accordance with the statement of work and/or providing a copy of the solicitation in response to the solicitation is considered unacceptable. The quote will be determined nonresponsive and removed from further consideration.
A complete quote shall be submitted by solicitation the closing date and time.
The contractor is responsible for reading this solicitation in its entirety.
The contractor shall identify the company Tax ID, Cage Code, UEI number.
The quote shall be submitted using FOB Destination delivery terms.
The contractor shall complete and submit the SF-1449 with the quote.
The contractor shall include complete and current point of contact information to include first name, last name, e-mail, telephone number, fax number, and physical mailing address.
The contractor shall acknowledge all amendments, if any.
The contractor shall be properly registered in SAM.gov to include small business status.
The contractor shall complete the provisions, FAR & DIAR, and submit with offer. (Section E)
Completion of FAR provisions is not necessary if the provisions are already complete & listed in the company SAM.gov registration, representations, and certifications section.
• The contractor shall review the evaluation criteria, 52.212-2, and submit a quote accordingly.
• The Government shall not be liable for any fees/costs incurred by quotation preparation. Preparing and submitting an offer in response to this solicitation is strictly voluntary.
• E-mail attachments shall be in PDF format and compatible with Microsoft Office software.

Product Specifications: The contractor shall submit product specifications/drawing/designs with the quote.
The contractor shall NOT quote items that are refurbished, grey market items, on backorder, or require manufacturing to deliver. All products shall be fully manufactured, available in stock, and ready to ship.
Delivery: The quote shall clearly identify a project milestone and delivery lead time.
Pricing: The contractor shall submit a firm fixed price all-inclusive quote. All-inclusive is defined as all costs/expenses to include but is no limited to service, labor, supplies, materials, Federal/Local/State tax, travel, shipping & handling, and all other fees necessary to complete the work. As part of the all-inclusive price quote, the contractor shall provide itemized pricing details which includes taxes, shipping, and handling.
Qualifications & Capabilities: The contractor shall provide the company qualifications, experience, and capability providing similar contract services, as it relates to this requirement. The contractor shall explain in the quote the project management plan and the means that will used to accomplish the contract requirements.
Set-aside: The contractor shall complete and submit the DIAR IEE representation, 1452.280-4 Indian Economic Enterprise Representation (FEB 2021), included in this solicitation. Alternate forms, revisions, or substitutes shall not be accepted.
Technical Questions & Answers: Technical questions pertaining to this opportunity are due by August 17th, 2023, 1430 EST. Answers to the questions will be posted approximately on August 18th, 2023, 1430EST. All questions should be emailed to the Contracting Specialist at kelly.holznagle@bie.edu
52.212-2 Evaluation—Commercial Products and Commercial Services (Nov 2021)
(a) The Government will award a firm fixed price contract resulting from this solicitation to the responsible contractor whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following criteria shall be used to evaluate quotes:
Technical:
Product Specifications & Delivery: The government will review the quote to determine whether the specifications quoted are complete and will meet the government need. The government will review the project milestone and delivery lead time identified in the quote.
Qualifications & Capabilities: The government will review the company qualifications, experience and capabilities as it relates to this requirement to include the project management plan and the means that will be used to accomplish the contract requirements.
Set-aside: The government will evaluate each quote to determine whether or not the contractor meets the solicitation set-aside. The quote will be determined ineligible and removed from further consideration if the company does not meet the set-aside.
Price:
The government will review the price for completeness and reasonableness.
Quotes will be evaluated in accordance with FAR 13.106-2(b)(3) and will include comparative evaluations.
Acceptable quotes will be compared against each other to determine which quote provides the best value for the Government. The government reserves the right to consider a response that offers more than the minimum and select that response if it provides a benefit to the government. The government has the discretion to accept other than the lowest priced quote that provides those additional benefits.
(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
