THERE ARE NO KNOWN ENVIRONMENTAL ISSUES AS STATED IN THE ENVIRONMENTAL DOCUMENTS FOR EITHER BRIDGE:

THE FOLLOWING INFORMATION IS FROM “THE TRIBAL TRANSPORTATION PROGRAM, CATEGORICAL EXCLUSION DOCUMENTATION OF ELIGIBILITY, KICKAPOO TRIBE OF KANSAS, BIA PROJECT NUMBER B0422612, ROUTE 1008, NATIONAL BRIDGE INVENTORY (NBI), 00000000000B119, BROWN COUNTY, KANSAS” WHICH STATES “The BIA has reviewed and fulfilled the requirements of the U.S. Fish and Wildlife Service under section 7(c) of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et seq.). The Proposed Action will not affect threatened, endangered, or candidate species of animals or plants, nor hinder the habitat. Construction activities for the proposed action will be temporary and should enhance the natural habitat by establishing permanent vegetation, with less soil erosion created by storm water runoff.”

2. Are there any fish are aquatic animals need to be specially considered for environmental concerns? Both bridges have active streams running beneath the bridges.

3. Are there any tribal fees, costs or taxes for removal or bringing construction materials onto the reservation?

NO.

4. Is there a TERO ordinance or tribal taxes to be aware of?

NOT ERO TAX, THIS WAS ADDRESSED IN THE SOLICITATION UNDER ITEM #9 IN THE DECRIPTION ON THE SF-1442

5. Can the quality control manager, superintendent or the safety officer have combined duties, or do they have to have separate duties? Can the control manager, and safety officer be the same person? Allowing one person to have combined duties can reduce the number of personnel and lower costs.

DUE TO THE MAGNITUDE OF THE PROJECT, YES, THEY CAN BE THE SAME

6. Is there a staging area for equipment and material at bridge site? Where are locations to stage in store material and equipment?

THE KICKAPOO TRIBE MUST BE CONTACTED FOR THE LOCATION OF STAGING AREAS. MR. JAMES KEO, PH 785-933-2500 JAMES.KEO@KTIK-NSN.GOV IS THE TRIBAL TRANSPORTATION PLANNER AND SHOULD BE ABLE TO PROVIDE INFORMATION ON SUITABLE STAGING AREAS.

7. Can the 90-day time for each bridge be revised to 120 per bridge?

YES, THE 90-DAY TIME FOR EACH BRDIGE CAN BE REVISED TO 120 DAYS PER BRIDGE.

8. Can the contractor build both bridges at the same time and the contract time revised to 180 days? The contractors noted that 90 days for bridge is a pretty short time and would prefer 120 days per bridge if the bridges must be built one at a time. There are time requirements for the curing of the poured concrete which will result in substantial no-work times which could be used at the other bridge if both bridges are under construction at the same time.

YES, THE 90-DAY TIME FOR EACH BRDIGE CAN BE REVISED TO 120 DAYS PER BRIDGE.

BOTH BRIDGES, B119 AND B104, CANNOT BE BUILT AT THE SAME TIME. THEY ARE LOCATED ON PAVED ROADS THAT ARE PRIMARY ROUTES USED BY THE KICKAPOO COMMUNITY AND ARE ALSO PART OF THE SCHOOL BUS ROUTE SYSTEM. CLOSING BOTH BRIDGES AT THE SAME TIME WOULD PLACE AN UNDUE BURDEN ON THE LOCAL COMMUNITY.

9. Is an environmental manager required to be on the project site?

YES, AN ENVIRONMENTA MANAGER IS NOT REQUIRED TO BE ON THE PROJECT SITE AND CAN BE THE THE QUALITY CONTROL MANAGER, SUPERINTENDENT CAN BE THE SAME WITH SHARED ROLES.

10. What are the review times for the submittals?

The Kansas DOT specifications should address the time limit for submittals.

DUE TO THE MAGNITUDE OF THE PROJECT, YES, THEY CAN BE THE SAME

12. Is there a copy of the geotechnical report for each job site available to be provided? If not, just a geotechnical survey be conducted before construction?

COPIES OF THE GEOTECHNICAL REPORTS FOR BOTH BRIDGES ARE ATTACHED TO THISAMENDMENT.

13. L. 8. Projects - Page limits state there is a two-page limit for past performance, however, the solicitation states that we can provide between 3-5 projects. Would you consider increasing the page limit for projects to allow adequate space to address the information requested for each project including: "The description should state the scope of work performed and the relevancy to the project requirements of this solicitation (i.e., unique features, area, construction methods, location, customer, etc.)."?

PAGE LIMIT INCREASED TO NO MORE THAN 5 PAGES

14. L.9.3. Factor 3: Key Personnel: Principal Architect - does this role/resume need to be included since this is not a design-build project?

NO

15. M.5. Factor 3: Key Personnel: The Project Manager role states that "10 years design-build construction management experience" is required. Since this is not a design-build project, please verify if this is accurate.

REMOVED, DOES NOT APPLY TO THIS PROJECT. INCLUDE EXPERIENCE, FOR REFERENCE, BUT THERE IS NOT A MINIMUM THAT IS REQUIRED

16. Please confirm if a bid bond is required. The SF1442 form states it is NOT required, however, this contradicts L.10.1.7. Section 6, stating we must provide "Fully executed Bid Guarantee, Standard Form (SF) 24, Bid Bond."

SF-24 IS REQUIRED

17. SF1442 – Section H - Please confirm if sales taxes are exempt. Will the client issue a Tax-Exempt Certificate?

CONTRACTOR WILL BE PROVIDED A TAX-EXEMPT CERTIFICATE FROM THE STATE OF KANSAS FOR THIS PROJECT. THIS CANNOT BE ISSUED UNTIL AFTER CONTRACT AWARD AND IS IN THE NAME OF THE CONTRACTOR AWARDED THE CONTRACT.

18. Is the work on federal land?

YES, THIS IS A FEDERAL RESERVATION

20. We assume permits are not required if on federal land. Please confirm.

CONFIRMED, NO PERMITS REQUIRED

21. The surfacing material called for on sheet 36 for bridge B119 is 483 TONS Surfacing Material (AB-3). The Bid Schedule for Bridge B-119 had it stated as 6” Aggregate Base bid item with a quantity of 483 Sq.Yds, which is incorrect. The bid quantity should state “483 Tons” and not “483 Sq.Yds”. A revised Bid Schedule for B-119 is attached.
