This is a Trench Safety Act Requirement form issued by Broward County, Florida, for the Lift Station Rehabilitation and Repair open-end contract. The form requires vendors to acknowledge compliance with Florida's Trench Safety Act (Sections 553.60-553.64, Florida Statutes) and OSHA excavation safety standards (29 C.F.R. Section 1926.650) for any project involving trenches exceeding 5 feet in depth. Vendors must submit the completed form with their initial bid submittal or, if not provided, within three business days of the County's request. Failure to meet these timeframes may result in a vendor being deemed nonresponsive. The contract covers repair and rehabilitation of sewer lift stations and appurtenances for Broward County's Water and Wastewater Services and other county agencies, including essential bypass pumping, wet well restoration, replacement of structural, mechanical, and electrical components, and site restoration as directed.

Vendors are required to identify and document anticipated methods and associated costs for compliance with applicable trench safety standards, including special shoring requirements where applicable. The form provides separate sections for open-end and fixed contracts, with vendors detailing unit prices and compliance methods for linear feet of trenching and square feet of special shoring, if needed. This assurance of compliance is legally binding on all vendor employees and subcontractors. The form was dated September 9, 2024, and vendors must submit all solicitation responses electronically through BPRO with receipt confirmation by the stated closing date and time.
