About this file

This file is a compliance guidance document issued by the Harris County Department of Economic Equity and Opportunity (DEEO) outlining the procedural requirements for Minority/Women-Owned Business Enterprise (M/WBE) trucking companies to perform a Commercially Useful Function (CUF) on Harris County contracts. The document establishes criteria that M/WBE trucking firms must meet to receive credit toward M/WBE contract participation goals, including ownership and operation of at least one truck, employment of at least one driver, management and supervision of the entire trucking operation, and performance of at least 30 percent of the work with the firm's own forces. The guidance specifies that M/WBE firms must employ their own drivers rather than utilize independent contractors and must be certified through one of the certifications recognized by Harris County to qualify for credit.

The document details four distinct scenarios for receiving M/WBE credit based on truck ownership and leasing arrangements, with credit calculations varying from 100 percent of expenditures paid to the M/WBE firm to commissions and fees only, depending on the configuration of owned and leased trucks. Vendors must submit required documentation with their M/WBE Utilization Plan, including W-9 forms, current insurance documents, and proof of truck ownership or registration on the TxDOT website. The DEEO offers a courtesy review process for Utilization Plans submitted up to five business days prior to solicitation closure, and vendors may contact DEEO at (713) 274-1400 or DEEO@eeo.hctx.net for additional program information and policy details.
