Any pricing assumptions, conditions or exceptions found elsewhere within the submission will not be evaluated or incorporated. Additionally, the offeror shall include a copy of its FSS price list with its pricing narrative.

3.0 Evaluation Method and Factors

The Government intends to issue five BPAs resulting from this RFP to the responsible offeror(s) whose proposals result in the best value to the Government, considering both price and non-price factors using the trade-off method of analysis. In determining which proposal provides best value to the Government, an integrated evaluation and assessment of offers will be conducted. The best value determination will be accomplished by comparing the merits of the differences in the Technical Evaluation Factors for competing offers with the merits of the differences in their price to the Government. In making these comparisons, the Government is more concerned with obtaining superior non-price capabilities than with making an award at the lowest overall price to the Government.

The following factors will be used; Technical, Past Performance and Price. The Technical factor is more important than the Past Performance factor. When the two non-price factors (Technical and Past Performance) are combined, they are approximately equal to Price. In the event of essential equality in the total non-price factor evaluation between one or more offerors Price may become more important.

12 | P a g e

Based upon the results of the integrated assessment of the price and non-price factors, the Government may make an award to other than the lowest-priced offeror or the offeror with the highest technical score if the source selection official determines that to do so would result in the best value to the Government.

Proposals will be reviewed for page limitations. Pages exceeding the page limitation will be eliminated from evaluation.

Evaluation Rating

The evaluation of each non-price factor (Factors 1, 2 and 3) may be done holistically with a rating scale of "high confidence," "some confidence," and "low confidence," representing the Department’s confidence that the Quoter understands the requirement and will be successful in performing the work per factor.

Confidence Ratings:

High Confidence The Government has high confidence that the Quoter understands the requirement, proposes a sound approach, and will be successful in performing the agreement with little or no Government intervention.

Some Confidence The Government has some confidence that the Quoter understands the requirement, proposes a sound approach, and will be successful in performing the agreement with some Government intervention.

Low Confidence The Government has low confidence that the Quoter understands the requirement, proposes a sound approach or will be successful in performing the agreement even with Government intervention.

All quotes shall be evaluated by the Department in accordance with the factors and criteria established above.

Award on Initial Responses

The Government anticipates selecting the best-suited quoter from initial responses, without engaging in exchanges with quoters. Quoters are strongly encouraged to submit their best technical solutions and price in response to this RFP.

**for past performance, an additional rating of neutral (not a positive or negative rating) may be applied where there is not past performance information available.

13 | P a g e

• A Weakness is defined as a flaw in the proposal that increases the risk of unsuccessful contract performance. Weaknesses must be tied to an impact or concern for meeting the requirements.

• A Significant Weakness is a flaw that appreciably increases the risk of unsuccessful contract performance. Significant Weaknesses must be tied to a significant impact or concern to meeting the requirements.

• A Deficiency is defined as a material failure of a proposal to meet a government requirement or a combination of Significant Weaknesses in a proposal that increases the risk of unsuccessful performance to an unacceptable level.

• A Risk is defined as an aspect of the proposal that raises uncertainty and may have an adverse impact. Risks may be tied to schedule, cost, or performance.

The Government at its sole discretion reserves the right to award without discussions if the Contracting Officer determines that the initial offer is fair and reasonable and that discussions are not necessary.

The following factors will be used to evaluate proposals.

1 Technical

The Offeror’s Technical Proposal will be evaluated on how well the Offeror has demonstrated that its proposal meets all minimum requirements and clearly addresses each of the technical elements. All three elements will be considered equal in terms of importance.

1. Workflow Management

2. ROI Sample

3. Technical Ability of Staff

Element 1: Workflow Management

Evaluation of Workflow Management will consider to what extent the following areas demonstrate a strong approach and a high degree of technical acumen:

1. How does the Offeror monitor the work assignments being performed by subcontractors (Investigators)

2. How does the Offeror communicate with staff and COR (staff includes subcontractors), including how Offeror handles problems with subcontractors or unhappy parties involved in the investigation.

3. How does Offeror assure technical quality is produced.

4. How does Offeror share and protect PII with subcontractors.

5. How does Offeror ensure timely completion of the Report of Investigation (timeline from receipt of assignment to completion).

Element 2: Report of Investigation (ROI) Sample

14 | P a g e

Evaluation of ROI Sample index and summary will include a review of the following:

1. Statements obtained from the appropriate parties involved or who witnessed the incident

2. Appropriate documentation obtained.

3. Appropriate comparable evidence obtained.

4. Appropriate regulation or agency policy obtained for the accepted claims under investigation.

The Government will evaluate to what extent the ROI sample is complete, accurate, and demonstrates a strong approach and a high degree of technical acumen.

Element 3: Technical Ability of Staff:

Evaluation of the Technical Ability of Staff will consider:

1. Whether the investigators currently conduct Federal Sector EEO Investigations (recency is preferred).

2. How many years have the staff conducted Federal Sector EEO Investigations (higher is preferred).

3. Whether the staff has experience in managing Federal Sector EEO Investigations.

4. Whether support staff and investigators have the ability and knowledge to work with all aspects of Adobe Professional.

5. Whether/to what degree do the staff understand the requirements of MD-110.

Higher levels of ability are preferred.

2 Past Performance

The Government will evaluate the relevant merits of the offeror's past performance on the basis on its record with its current and former customers. The Government will review the following areas regarding past performance:

• Timeliness – Delivery or Performance

• Management - Responsiveness

• Quality of Products or Services Provided

• Compliance with Subcontracting Plans/Goals (if applicable)

Offerors are reminded that both independent data and data provided by offerors in their proposals may be used by the Government to evaluate offeror past performance. However, the burden of providing thorough, complete, and current past performance information as requested herein remains with the offeror. In the case of an offeror without any performance history, past performance will be evaluated as “neutral.” A neutral rating is neither an advantage nor disadvantage to the Offeror.

3.3 Price

Proposed prices will be evaluated but not scored. The price evaluation will determine whether the proposed prices are complete and reasonable in relation to the solicitation requirements, GSA MAS pricing, and market rates. Proposed prices must be entirely compatible with the technical proposal and consistent with the pricing requirements listed in this solicitation. The offeror’s price as derived from the Price Schedule Template will be the total evaluated price for purposes of the source selection tradeoff analysis and best value determination.
