About this file

This is a non-competitive justification document for a sole-source maintenance agreement procurement. The National Institutes of Health (NIH), Office of Logistics and Acquisition Operations, seeks a maintenance agreement for three Thermo Fisher Scientific analytical instruments: the Orbitrap Ascend, Orbitrap Fusion, and Vanquish systems (Solicitation 75N98026Q00755). The justification supports awarding the contract on a non-competitive basis directly to Thermo Fisher Scientific, the original equipment manufacturer, due to the specialized nature of these instruments and the requirement for manufacturer-specific expertise, parts availability, and warranty compliance. The procurement is for comprehensive maintenance services covering preventive maintenance, repairs, technical support, and replacement parts necessary to keep the analytical systems operational for ongoing research activities at NIH.

The document establishes that competition is impracticable because these instruments require manufacturer-authorized service personnel and genuine Thermo Fisher parts to maintain performance specifications and calibration standards critical for analytical research. Awarding to the manufacturer ensures continuity of service, access to specialized technical documentation, and preservation of equipment warranties. This sole-source approach streamlines the procurement process while guaranteeing the laboratory receives appropriate maintenance support for equipment essential to its research mission.
