About this file

This document is Exhibit E - Performance Measures and Liquidated Damages for RLI 25003JD, a contract exhibit established by the Broward County Sheriff's Office for workers' compensation claims administration services. The exhibit establishes eleven specific performance standards that proposers must meet, including three-point contact requirements for medical and lost time claims within three working days, detailed reserve calculation worksheets for files over $50,000, medical bill payment within 45 days, indemnity payment processing in accordance with Florida Workers' Compensation Statute, supervisor reviews of new and open lost time claim files, Florida state forms submission, file closing within 60 days of last activity, adjuster claims load limits of 150 open lost time files maximum per adjuster, comprehensive bill review with fee schedule compliance, and preferred provider organization (PPO) network services. Each performance standard requires a minimum 95% compliance rate and will be measured annually through claims and performance reviews conducted either by the Broward County Sheriff's Office's own personnel or an independent third-party auditor.

The liquidated damages for non-compliance range from 1% to 5% of that year's Claims Administration Fees depending on the specific performance standard violated, with comprehensive bill review and PPO network services assessed at $2 per medical bill reviewed if discount guarantees are not met (minimum 28% average discount off billed charges for comprehensive bill review and minimum 2% average discount off Florida fee schedule for PPO services). Performance audits will utilize statistically valid random samples with a confidence interval no greater than plus or minus 3% and a confidence level of at least 95%, conducted no more than once per contract year. The Broward County Sheriff's Office reserves the right to reduce or waive liquidated damages due to extraordinary circumstances, and any assessed damages become due within 30 days of written notification, with the cost of annual audits split equally between both parties.

EXHIBIT E | Performance Measures and Liquidated Damages | RLI 25003JD

EXHIBIT E - PERFORMANCE MEASURES AND LIQUIDATED DAMAGES

The PROPOSER must agree to the following minimum performance standards and applicable liquidated damages. At the Broward County Sheriff’s Office discretion, an audit of the accuracy of the PROPOSER’s results will be performed via a randomly selected, statistically verifiable sample of claims by a qualified, independent third party. The results of the audit after appropriate review and comment by the PROPOSER will be the final determinant of performance standard compliance. When sampling methods are used to estimate performance for the universe of claims, audit samples will be large enough to ensure a confidence interval whose deviation is no greater than plus or minus three percent (3%) and whose confidence level is at least ninety-five percent (95%). The Broward County Sheriff’s Office will consider the point estimate for the sample as the PROPOSER’s performance level in calculating liquidated damages.

The Broward County Sheriff’s Office’s reserves the right to reduce or waive any liquidated damages if, in the Broward County Sheriff’s Office’s sole discretion, failure to meet a performance standard was due to extraordinary circumstances.
