A bid guarantee will NOT be required. In addition, there is a requirement for performance and/or payment protections (performance bond and/or payment bond or Irrevocable Letter of Credit (ILC)). If quote is between $35,000 and $150,000, payment bond or ILC will be required for 100% of the award price and be submitted within 10 days after contract award. Quote incorporates all amendments and Q&A's (if any) that have been posted to beta.sam.gov. Submit quotes by the date and time stated in Block 13a or as amended.
Inquiries
Any prospective quoter desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must request it in writing, not later than 4 business days before the closing date, to allow a reply to reach all prospective quoters before submission of their quotes. Oral explanations or instructions given before the award of a contract will not be binding. In no event shall failure to inspect the site constitute grounds for a claim after contract award. Requests for explanation or interpretation of the solicitation, drawings, specifications, etc. may be submitted by email to Tracy Marino at tracy.marino@usda.gov.
Instructions for Submission of Quotes
(a) Submit signed and dated quotes to the office specified in this solicitation at or before the exact time specified in this solicitation. Quotes should be submitted via the Schedule of Items plus Technical Response documents of the Quoter's design as specified in the solicitation. Quotes shall be submitted in two parts (technical and price). Each part shall be separate and complete in itself so that evaluation of one may be accomplished independently of the other.. As a minimum, quoters must show:
(1) Pricing and Contact Information (use SF 1442 and Schedule of Items (Section 00 10 00)). This should be considered as your price submission)
(2) Acknowledgment of any Solicitation Amendments (use SF 1442);
(3) Response to non-price evaluation factors (see Section 00 21 00, Evaluation).
(4) All applicable fill-in provisions. For solicitations issued on an SF 1442, this would include Section 00 45 00.
(b) Late submissions, modifications, revisions, and withdrawals of quotes. Quoters are responsible for submitting quotes, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. Quotes received after the designated time may not be considered if the Contracting Officer has begun the evaluation process.
(c) System for Award Management (SAM). To be considered for award all Quoters must be successfully registered in the SAM database (www.sam.gov) AT THE TIME A QUOTE IS SUBMITTED. See FAR Clause 52.204-7, System for Award Management, as applicable for requirement information. Contractors shall have representations and certifications completed in www.sam.gov OR provide FAR clause 52.204-8, Annual Representations and Certifications, with paragraph (c) completed. If completing the aforementioned clause, provide with submitted quote.
(d) Unique Entity Identifier (formerly Data Universal Numbering System (DUNS) Number. Place the annotation "Unique Entity Identifier" as well as Electronic Funds Transfer (EFT indicator, if applicable (formerly DUNS+4)" next to your name and address on the first page of your quote. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Quoter to establish additional mailto:tracy.marino@usda.gov http://www.sam.gov/
SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Quoter does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Quoter should indicate that it is a Quoter for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.
(e) Electronic Submissions
(1) Quoters must submit electronic responses this solicitation. Email quotes to tracy.marino@usda.gov. Please limit the size of your file to 5 MB or less; more is not always better, so please be concise. Include the solicitation number in the subject line of the email. Files in Adobe Acrobat are the preferred file type; other types may be accepted but the quoter may be required to change type if the Government cannot open the attachment.
(2) If any portion of a quote received by the Contracting Officer is unreadable to the degree that conformance to the essential requirements of the solicitation cannot be ascertained from the document--
(i) The Contracting Officer immediately shall notify the quoter and permit the quoter to resubmit the quote.
(ii) The method and time for resubmission shall be prescribed by the Contracting Officer after consultation with the quoter; and
(iii) The resubmission shall be considered as if it were received at the date and time of the original unreadable submission for the purpose of determining timeliness, provided the quoter complies with the time and format requirements for resubmission prescribed by the Contracting Officer.
(3) Facsimile Submissions will not be accepted.
(4) Hard Copy Submissions will not be accepted
Basis for Award
(a) The contracting officer shall make a contract award (1) by written or electronic notice; (2) within the time for acceptance specified in the quote or an extension; and (3) to that responsible quoter whose quote, conforming to the solicitation, will be most advantageous to the Government. The Government intends to do a comparative analysis of quotes and award a contract without communication with Quoters. Therefore, the Quoter's initial response should contain the Quoter's best terms from a price and technical standpoint. However, the Government reserves the right to communicate if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest (i.e. cost prohibitive); accept other than the lowest-priced quote; and waive informalities and minor irregularities in quotes received. If a quote is rejected, it will not be considered for award.
(b) The Government will determine the acceptability of each quote on a pass or fail basis considering the following factors. Quotes that fail any of these elements will not be considered for award.
(1) A quoter takes exception to the any of the terms and conditions of the RFQ, including attachments.
(2) A quoter is not currently registered in the System for Award Management (SAM) by the closing date of the solicitation.
(3) A quoter cannot be verified as a Small Business as shown in SAM or other proof as submitted by the quoter.
(4) An incomplete quote that lacks sufficient information for the government to perform a technical evaluation to determine acceptability.
5) A quoter failed to acknowledge a material amendment; and
6) not furnishing prices for each item listed in the Schedule requiring a unit price. If the quoter fails to insert a unit http://www.sam.gov/ mailto:tracy.marino@usda.gov price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. Should any mathematical check made by the Government show a mistake in the extended amount quoted, the corrected unit price extension shall govern. If a quoter omits both the unit price and the extended amount or estimated amount for any item, its quote shall be declared unacceptable and therefore ineligible for award. Pricing must be submitted for all items. If the quoter does not intend to charge for a bid item, a price of "0" or "No Cost" should be shown.
(c) To be determined responsible, a prospective contractor must --
(1) Have adequate financial resources to perform the contract, or the ability to obtain them;
(2) Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments;
(3) Have a satisfactory performance record. A prospective contractor shall not be determined responsible or non-responsible solely on the basis of a lack of relevant performance history;
(4) Have a satisfactory record of integrity and business ethics;
(5) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors).
(6) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them;
and
(7) Be otherwise qualified and eligible to receive an award under applicable laws and regulations.
(d) Remaining quotes will be evaluated and award will be made as a whole to one quoter.
Evaluation
Contract award will be made based on the solicitation response that represents the best value to the Government using a Contracting Officer's Comparative Analysis. Since the Contracting Officer is considering price and other factors, award may be made to other than the lowest-priced quote.
(a) The following factors will be used to evaluate quotes:
Factor 1: Contractor's General Technical Capability, Factor 2: Similar Experience, and Factor 3: Past Performance; It is preferred but not required that Quoters use the attached Questionnaire to respond to these factors.
If the Quoter chooses not to use the attached questionnaire, they must address all questions (if all questions are not addressed the government may choose to not evaluate your technical response). The Government will be assessing the Quoters understanding of the work and whether previous experience is similar to the work to be performed in this contract and reflects a positive record of customer satisfaction and contract compliance, so Quoters should select projects they believe best offer this evidence. The Government is not limited to Contractor-provided references and may obtain performance information from other sources.
Factor 4. Price: Quoters shall submit a price quote for this project by utilizing the Schedule of Items. It is the Government's intent to assess the unit prices to determine reasonableness and Quoters understanding of the work and ability to perform the contract.
(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options will not obligate the Government to exercise the option(s). Options may either be exercised at time of award or a later date.
(c) A written notice of award or acceptance of a quote, furnished to the successful quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote's specified expiration time, the Government may accept a quote (or part of a quote), whether or not there is communication after its receipt, unless a written notice of withdrawal is received before award. The Government intends to offer award to the single quoter whose price quote and technical response offer the best value combination to the Government.
Quote Submission Checklist

52.204-7 System for Award Management. (OCT 2018)
52.222-5 Construction Wage Rate Requirements-Secondary Site of the Work. (MAY 2014)
(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.
(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

52.222-23 Notice of Requirement for Affirmative Action To Ensure Equal Employment Opportunity for Construction. (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.
(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled Affirmative Action Compliance Requirements for Construction, and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the-
(1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;
(3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and
(5) Geographical area in which the subcontract is to be performed.

52.225-10 Notice of Buy American Requirement - Construction Materials. (MAY 2014)
(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American-Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225- 9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers. (1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers. (1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested-
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.

SECTION 00 24 - 00 - Procurement Scopes
1. DESCRIPTION OF WORK
Furnish all labor, materials, equipment, and other incidentals necessary to:
· Remove and replace all decks and all components (stairs, railings, bench, structural components, etc.) on the Longbell Modular Barracks. New decks shall use composite decking material. Materials from current decks may be reused if they meet specifications.
· Remove and replace roofing on the Longbell Fire Office with screwless or hidden fastener high-rib style metal roofing. Remove chimney from roof. Complete any structural repairs necessary before installation of new roofing.
Some water damage may be present.
· Remove and replace exterior office door and frame with heavy-duty steel door. New door design should not have windows.
· Option 1- Remove and replace all siding and trim on Barracks. Complete any needed repairs or replacement of insulation.
· Option 2- Remove and replace all flooring in Fire Office with commercial grade vinyl plank flooring. Complete any structural repairs necessary before installation of new flooring.

3. CONTRACT TIME
Contractor shall complete the work as stated in FAR clause 52.211-10. The time stated for completion shall include final cleanup of the premises. Premises will be occupied between May and October during which time site will not be available for work. Each individual piece of work shall be completed after October.
4. SPECIAL CONDITIONS AFFECTING WORK
The contractor shall be required to provide product submittals to the Contracting Officer (CO) for proposed roofing and decking systems, per the specifications. Contractor shall provide all roofing and decking materials and incidental supplies. Installation shall provide a complete and usable roofing system including but not limited to all surfacing materials, associated venting, penetration sealing, and replacement of any existing gutters. Installation shall comply with contract specifications and manufacturer¿s installation instructions. All installations must comply with Modoc County Building Codes. Contractor shall dispose of all waste, including removed roofing and decking materials. Up to 15% of the roof structural assembly, including sheathing, rafters, fascia, soffit, vent assemblies, and other roof components, if damaged, will be replaced or repaired per the CO with no modification to this contract.
Additional needs will be addressed via negotiation and contract modification.
Due to Covid-19, contractor must provide their own sanitation facilities on site. A trailer pad may be available on site and can be coordinated after contract award.
All work shall be performed by a contractor licensed to install scheduled items in the State of California.

52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment. (OCT 2020)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Items. (ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to-
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that-
