52.212-1 Instructions to Offerors – Commercial Items (OCT 2018)
52.212-2 Evaluation – Commercial Items (OCT 2014) (FAR Provision)
(a) The Government expects to make an award to the lowest priced, technically acceptable offeror. The following factors shall be used to evaluate offers for technical acceptability:
Past Performance on Similar Projects Safety Record Technical Approach http://www.acquisition.gov/far/
Contractors must be rated technically acceptable for all factors to be considered technically acceptable overall. Technical evaluations will be completed on the lowest priced offer first. If that offer is technically acceptable, evaluations will not be performed on the remaining higher priced offers. If it is not technically acceptable, the next lowest priced offer will be evaluated, and so on until the lowest priced technically acceptable offer is identified.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Offer Submission Information:
Contractors will be evaluated for technical acceptability based on the factors contained in FAR Clause 52.212-2:
Past Performance on Similar Projects Safety Record Technical Approach
Contractors shall submit a list of references with contact information for similar projects completed within the last three years. Past Performance will be evaluated in terms of similarity of the work to this requirement, quality of work, timeliness, cost control, and customer satisfaction on past abatement type projects. The Forest Service may use sources of information other than what is provided to evaluate past performance. A contractor with no record of past performance will be evaluated neutrally in this factor.
The Forest Service will access the OSHA website for contractor safety inspection results for the Safety Record evaluation factor. https://www.osha.gov/oshstats/index.html
Contractors shall submit narrative on the way they plan to approach this project, including personnel and equipment to be used. All aspects of the work, including disposal, shall be addressed in this document. Include information on any subcontractors to be used. Note that FAR Clause 52.219-14 requires that 50% of the work be performed by employees of the prime contractor.
The past performance references and technical approach narrative will form your technical proposal.
A technically acceptable rating is given to submissions where the contractor and all subcontractors have acceptable past performance on similar projects, an acceptable safety record, and a sound technical approach indicating that they can perform this contract successfully.
A technically unacceptable rating is given to those submissions that 1) fail to meet minimum evaluation standards, 2) have a low probability of satisfying the requirement, and/or 3) have significant deficiencies, even though they may be correctable. An unacceptable rating for any of the evaluation factors will result in an overall unacceptable rating.
