GENERAL INFORMATION

The Cherokee National Forest is soliciting for construction services to include facility renovation, remodeling, repair, and minor new construction. Work will be performed at recreation or administrative sites within the administrative boundaries of the Forest.

This solicitation will result in the award of multiple indefinite delivery/indefinite quantity task order contracts with one base period and four option years that may be exercised at the discretion of the Government. The guaranteed minimum amount for each awarded contract, inclusive of the base and all option periods, will be $10,000. Orders issued by the Government will include complete specifications and drawings (if needed) for the work required. The type of work will vary per task order.

Price range for each task order shall be between $2,000 and $150,000. Each awarded contract shall not exceed $950,000 over the base period and four option years.

REPRESENTATVE TASK ORDER INFORMATION

The representative task order(s) included in this solicitation is for - See Schedule B.

Offerors are required to submit pricing for the representative task order using the Schedule of Items, Section B and Attachments 1 and 2.

Specifications, drawings, and wage determination for this task order are listed in Section J and included as an attachment to this solicitation.

Award of this task order may not be made from pricing submitted in response to this Request for Proposals.

PROPOSAL PREPARATION AND SUBMISSION REQUIREMENTS

This section provides general guidance for preparing proposals. Proposals must include all data and information requested by this solicitation and must be submitted and conducted in strict accordance with these instructions and instructions in Section L.

1. Offerors shall submit original and one copy of a Business Proposal. This will include:

a. Standard Form 1442 - complete blocks 10, 14, 15, 17, 19, 20A, 20B, and 20C.

b. Pricing for Representative Task Orders - complete Schedule of Items. (Schedule B and Attachments 1 & 2)

c. Representations and Certifications – Section K.

2. Offerors shall submit original and one copy of a Technical Proposal. This will consist of a completed Experience Questionnaire

(attachment 4). Do not include pricing information in your technical proposal. When listing experience, show only your work most relevant to this solicitation. (See Section M for description of relevant work).

The technical and business proposals for the award of the basic IDIQ contract(s) will be evaluated based on information relative to both the overall Scope of Contract, and information presented for the representative task order. The evaluation criteria are described in Section M.

Offerors lacking recent and relevant present/past performance experience may submit information regarding key personnel who have recent and relevant experience. In this case, offerors shall provide the following information, as a minimum, to allow the government to conduct a past performance evaluation for those key personnel cited by the offeror:

SECTION C – DESCRIPTION/SPECIFICATION/STATEMENT OF WORK

1.0 PURPOSE

The USDA – Forest Service , Cherokee National Forest has a requirement to award an Indefinite Delivery/Indefinite

Quantity (ID/IQ) type contract to multiple contractors who offer the best value to the Government for construction related projects and services at multiple locations on the Cherokee National Forests in Tennessee, The Supervisors Office in

Cleveland, TN and the Chattanooga Air Tanker Base in Chattanooga, TN.

Due to the nature of the required construction related projects and services described herein, the Government has determined that multiple ID/IQ contracts will be awarded as a result of this Request for Proposal (RFP). The ID/IQ contract is designed to provide the Government with a contract vehicle that will allow for additional services to be ordered by the Government as needed and required, but cannot be reasonably determined in advance.

1.1 SCOPE OF WORK

The scope of work for this contract includes a broad range of facility maintenance, repair, remodeling, renovation, and new construction projects. Contractor shall furnish all labor, supervision, materials, equipment, transportation and incidentals to perform work in accordance with all terms, specifications, conditions, and provisions of this solicitation, and task order statements of work.

Construction-trade projects may include, but are not limited to: new construction or renovation work on buildings (for example, bathhouses or restrooms), campsites, pavilions, docks/piers, work centers, administrative buildings (including District Offices), etc., at Forest Service sites. Work may also include incidental road work and non-facility items, such as construction surveying and staking, clearing and grubbing, excavation, borrow, topsoil, concrete, asphalt, and culvert pipe

The Contractor shall be responsible and required to perform multi-disciplinary new construction, historic renovation, repair/remodeling/rehabilitation, remediation and/or demolition work using these trade workers. The work may include ancillary work including but not limited to site work, fences, drainage, sidewalks, utility systems, roads and parking lots, maintenance of facilities, repair and modifications. Other items may include inspections, energy audits, infrastructure assessments, evaluations, design services, cost estimating services, and drafting. The contractor shall also be required to provide 24 hour emergency response as needed.

Work shall include the preparation of Task Order Proposals to include project scoping, cost estimating, and development of Task Order specific specifications/requirement. In addition, the Contractor may be required to obtain all necessary permits, develop fire/erosion control/management/safety type plan(s), coordinate with private utilities providers, negotiate with State& local officials, and special consideration planning for development of the Task Order.

1.2 TASK ORDER CONTRACTING

All projects shall be issued through separate Task Orders, and will be competed between all ID/IQ contract holders awarded during RFP process. The successful offeror shall be responsible for the accomplishment of repair, alteration, modernization, maintenance, rehabilitation, energy performance upgrades, and construction of infrastructure, buildings, features, structures and other property, and other work as stated in the Task Order.

1.3 PLACE OF PERFORMANCE AND HOURS OF OPERATION

Normal operational hours are approximately from 07:00 am to 4:30 PM Easter Standard Time, Monday through Friday.

The following work sites will be located within the administrative boundaries of the Cherokee National Forest as follows:

Ocoee Ranger District, Benton, TN

Tellico Ranger District, Tellico Plains, TN

Unaka Ranger District, Greeneville, TN

Watauga Ranger District, Unicoi, TN

Jacobs Creek Job Corps Center, Bristol, TN

The following work sites are outside the administrative boundaries of the Cherokee National Forests as follows:

Chattanooga Air Tanker Base (CHA ATB), 1022 Jubilee Drive, Chattanooga, TN 37421

Supervisor’s Office, 2800 North Ocoee Street, Cleveland, TN 37312

Please note that access to the Chattanooga Air Tanker Base is restricted and requires training and badging. These additional requirements will be identified in the applicable task orders.

Work may be performed at administrative buildings, work centers, campgrounds, or other recreation facilities. Work may also be performed at remote Forest Service sites in rural/mountain locations. Access roads may be paved or gravel surfaced. Cell phone coverage may not be available; closest supply sources may be a 2-hour drive or more from work site. Potable water, electricity, and sanitary facilities may not be available at some sites.

Emergency services may be performed as required after normal business hours stated above or during the following

Federal Holidays:

1.4 CONTINUITY OF FACILITIES OPERATION AND HOURS OF OPERATION

Schedule all work to minimize interference with any on-site personnel and the facilities normal operations. Notify the

Contracting Officer and Contracting Officer’s Representative within 48 hours in advance of any shutdowns. The contractor shall coordinate with the Contracting Officer’s Representative to make all appropriate notifications to residents of building and recreation areas of any anticipated utility outages. The Contractor shall prepare a written response indicating a safety plan, fire protection plan and all other construction scheduling coordination. Perform all on-site work between the hours of 7:00 a.m. and 4:30 p.m., Monday through Friday (Federal Holidays excluded), unless otherwise approved by the Contracting Officer.

1.5 SITE MANAGEMENT

Maintain walkways, driveways, roads, parking, and project site to be free of all construction debris, equipment and materials on a daily basis. Maintain site free of hazards at all times. Occupancy access shall be negotiated on a project specific basis. Maintain the level of access provided to the facility through the project duration if tenant occupancy is

8 | 69 retained. Safety equipment, fencing and barriers shall be installed per safety plan. Erosion control and sedimentation structures shall be constructed in according with EPA standards as needed. Historical and/or archeological issues shall be addressed as needed.

1.6 NOTIFICATION OF START AND COMPLETION OF WORK

For each Task Order the Contractor will be issued a Notice to Proceed and work shall begin within (10) calendar days in advance of the date he intends to commence work Commence work includes ordering materials, mobilization, and work on site. The contractor shall notify the COR and CO five (5) calendar days prior to the date that work will be ready for final inspection.

1.7 RECYCLING AND DISPOSAL OF REFUSE

A waste management plan shall be established for each Task Order. The intent of this plan will be to recycle, reuse or salvage at least 75% of the waste materials (excluding native vegetative and soil debris) to regulated disposal areas unless otherwise described in the task order. With the exception of materials specifically indicated or specified to be salvaged for reuse in construction, or turned over to the Government; all refuse, excess or waste materials resulting from construction operations shall become the property of the Contractor (excluding native vegetative and soil debris) and shall be recycled and/or disposed of as required in the Task Order. All disposals shall be in accordance with federal, state, and local laws and regulations as per Task Order. No disposal, viewing or sale of materials and/or equipment shall be allowed on

Government property.

1.8 SAFETY

During the execution of this contract, the Contractor shall conform to the rules and regulations as set forth by OSHA

Safety and Health Standards, 29 CFR Part 1926 – Safety and Health Regulations for Construction or the US Army Corps of Engineers “Safety and Health Requirements Manual”, Sept 15 2008 (free online) whichever is more stringent.

Additional safety requirements are contained in Section H of the solicitation. Smoking will not be permitted in any building or structure. Fire precautions to prevent wildfire may be included in each Task Order or initiated when weather and site conditions pose a significant opportunity for ignition of wildfire.

1.9 TEMPORARY FACILITIES

(a) STAGING AREA: The Contracting Officer’s Representative shall arrange the location for exterior stockpiling of materials per Task Order location or by COR direction. . The Government will provide adequate staging area as close to the Task Order site as practicable.

In most cases, the Government will not provide any secured storage/staging areas for the Contractor. The Contractor shall be responsible for protecting materials stockpiled against adverse weather, damage, theft, and other risks of loss. The

Government assumes no responsibility for material or equipment left in the storage area.

(b) SANITARY FACILITIES: Toilet facilities will not be provided by the Government at Task Order sites unless specifically identified in the Task Order.

(c) WATER, AND ELECTRICITY: Water and 120V electricity may be available at no cost to the Contractor, depending on the location and as negotiated on individual Task Orders. Should water and electricity not be readily available, the contractor shall provide these services as needed to perform the required work.

(d) TELEPHONE: The Contractor may elect to hook-up commercial phone services using the local telephone service provider, at no cost to the Government. Cell phone or wireless access may or may not be available at the Task Order sites.

1.10 EXISTING UTILITIES

The contractor shall field verify all utility locations before digging or trenching. This shall include but not be limited to

9 | 69 the use of sonic, electronic or magnetic detection devices, by noting pull box and utility box locations at the surface, use of locator services, and by potholing. Contractor shall be responsible for repairing any utilities damaged during construction at no additional cost to the Government.

1.11 SPECIFICATIONS

The work shall conform to these specifications and any supplemental specifications and/or scope of work issued in conjunction with each individual Task Order. All work shall be performed in compliance with the most recent

International Building Code (IBC), Uniform Plumbing Code (UPC), International Mechanical Code (IMC), National

Electric Code (NEC), National Fire Protection Association (NFPA), the International Fire Code (IFC), United States

Nuclear Regulatory Commission (NRC)(when applicable) and the Occupational Safety and Health Administration

(OSHA) regulations.

1.12 DRAWINGS

The work shall conform to the drawings when provided with a Task Order.

1.13 CONSTRUCTION SCHEDULE/VALUES

For all task Orders exceeding 60 Calendar days; within one (1) week after approval or award of Task Order, the

Contractor shall prepare a construction schedule of activities indicating labor, materials and activity proposed for each day. A schedule of values linking the payment items to the Construction Schedule shall be prepared for each task. This spreadsheet shall describe multiple activities being proposed from start to finish of the project and show construction work completion in %.

The construction schedule shall define the overall time required to perform the identified work. This time schedule shall determine the overall level of effort by discipline for the task. Each major task, including beginning time and ending time, shall be identified within the schedule. Notify the Contracting Officer whenever there are significant departures from the approved Task Construction Schedule. Submit any requests to modify the Construction Schedule, in writing to the

Contracting Officer with an explanation for the deviation.

1.14 LIST OF POTENTIAL & TYPICAL TYPES OF WORK TASKS

The following list indicates various work projects and tasks that the Forest Service is intending to issue. These are just examples only and the actual tasks may vary. The Task Order will indicate the actual statement of work which the contractor(s) will bid for and construct.

1) Energy efficient lighting retrofits for interior and exterior application

a) Lighting fixtures and assemblies

b) Ceiling replacement anticipated in some applications.

c) Wiring, conduit, controls and panel board modification and troubleshooting.

d) Light Tube application optional.

e) LED lighting to be considered.

f) LED EXIT light replacement, which may include the coordination of the proper disposal of existing Tritium

Gas EXIT signs per NRC regulations.

2) Retrofitting thermal envelopes on existing buildings.

a) Demolish finish or siding surface of exterior walls or ceiling/ roofs.

b) Install combination or high R insulations to replace or add to existing.

c) Install and test air barrier to meet 0.05 cfm/sf @ 50 Pascal using 3rd party testing.

d) Install wrap and flashings to windows and other critical assemblies.

e) Replace interior and/or exterior surface with Green and sustainable materials.

f) Reglazing of existing windows and removal and caulking (sealing) around, windows, doors, and other envelope penetrations.

3) HVAC systems upgrades/performance improvements/troubleshooting.

a) Meet or exceed 30% energy reduction as compared to existing system or as directed in the TO.

b) Correct and replace system components, distribution problems and controls to achieve maximum occupancy comfort.

4) Window and door replacements to achieve maximum thermal performance and operation inefficiencies.

a) Interior/Exterior Doors, rated and non-rated

b) Overhead door and door operator replacement and/or repairs

5) Plumbing, water and wastewater upgrades/performance improvement that will conserve water and reduce pollution.

a) Replace and upgrade fixtures.

b) Upgrade distribution system and piping and other.

c) Replace hot water heating devices/boilers with Energy Star products where applicable.

d) Above/Underground leak detection and repairs

6) Photo Voltaic (PV) system installations and/or wind generation systems.

a) Install complete PV systems to provide required percentage of total building load as per Task Order.

b) Include complete installation and device needed to interface with existing systems.

c) All electrical installation shall meet NEC standards. Solar Panels Installation by NABCEP Certified Installer

7) Solar hot water Retrofits

8) Biomass heating system upgrades.

a) Provide biomass delivery, storage, application, combustion and distribution systems to interface with existing applications.

9) Electrical load reduction/troubleshooting

a) Evaluate existing system and reduce significant high electric load devices.

b) Replace dated, non-code compliant or old equipment

10) Roofing Replacement

a) Demolish existing roofing and/or other substrates.

b) Investigate and Repair Roof Leaks

c) Construct new roofing systems.

11) Siding Replacement

a) Demolish or cover existing siding systems.

b) Dispose of any hazardous material substances in State approved sites.

a) Provide interior or exterior painting to manufacturer’s recommended installation practices.

b) Use green and low VOC paints that meet or exceed LEED standards as approved by the COR.

13) On-site well renovation and upgrade.

a) Upgrade existing wells, casings, pumps and equipment.

b) Replace distribution systems.

c) Abandon existing wells in accordance with State and/or federal regulations.

d) Drill and install new wells (includes new hand pumps or pressurized systems)

2.1 GENERAL

(a) Definition: Submittals – Drawings and specifications may be required by task order. Additional product literature, catalog cuts, product samples, shop drawings, as-built drawings, Quality Control Plans, and other documents shall be submitted to the Contracting Officer for information or for review and approval when required by the Task Order.

(b) Submittals shall be presented in three copies unless indicated otherwise. The Contracting Officer will return one copy of the submittal to the Contractor, whether approved or rejected.

(c) Salient characteristics of the materials proposed for use shall be clearly identified in the submittal. The Project

Manager shall certify that he has reviewed the submittal and has determined that the submittal is in full compliance with the requirements of the Contract and Task Order. Illegible, incomplete, or uncertified submittals may be rejected.

(d) Submittals shall be approved by the Contracting Officer prior to any work being performed on the Task Order or materials being delivered to the job site.

(e) Review of submittals, and corrections or comments made during the review, does not relieve the Contractor from compliance with the requirements of this Contract.

(f) Allow 14 calendar days for government review of submittals. Review time shall commence upon receipt of a satisfactory submittal certified by the Project/Site Superintendent containing all information required to completely and thoroughly evaluate the submittal. Time shall start anew for each submittal and any required resubmissions.

2.1 TASK ORDER QUALITY CONTROL PLAN

The contractor shall maintain a Quality Control Plan for any Task Order exceeding $25,000. The plan should identify each major task to be performed. For each major task the plan should identify a quality standard that can be used to determine that the task has been successfully accomplished in full compliance with the requirements of this contract. For larger projects the plan may require periodic inspections, tests, or certifications.

This quality control plan shall be formatted with the construction schedule and shall include:

1. A complete description of the work task.

2. An explanation of the completion of the line item of work and what constitutes actual completion requirements.

3. Procedures to inspection of work.

The proposed Task Order Quality Control Plan shall be signed by the Project Site Superintendent prior to being submitted for review and approval. At the completion of the Task Order the Plan should be signed by the Project

Site Superintendent and submitted with the Task Order Invoice. See section G.3 for requirements for submittal of the Task Order Quality Control Plan with requests for payments.

2.2 CATALOG CUTS

Catalog cuts shall contain manufacturer's description, specifications and sketches of the material and equipment provided.

The catalog cut shall contain sufficient information, which can be used to determine compliance with these specifications.

Submit catalog cuts as required by a negotiated Task Order. Clearly indicate selected item and components being proposed.

2.3 SAMPLES

Product samples shall include color, pattern, style, and other information required to fully describe the items being proposed as required by the Task Order.

2.4 SHOP DRAWINGS

Submit shop drawings when required by the Task Order. Drawings shall indicate layouts, dimensions, materials, and other information required to fully describe the items being installed.

2.5 TEST RESULTS

Submit test results as required by the Task Order.

2.6 PERMITS AND CERTIFICATES

Submit copies of all permits and certificates as required by the Task Order. Where permits are required they will be reimbursed as identified in Section B.

2.7 HAZARDOUS MATERIAL IDENTIFICATION

Submit Material Safety Data Sheets (MSDS) for any materials defined as hazardous under the most current revision of

Federal Standard 313. Two (2) copies of each MSDS shall be submitted to the Contracting Officer no later than the delivery date of the product.

2.8 AS-BUILT DRAWINGS

When Shop Drawings are required by a Task Order, the Contractor shall maintain at the job site one (1) set of contract drawings marked in red to show any deviations which are found to exist or have been made from the contract drawings.

Upon completion of the work, the marked set of drawings shall be delivered to the Contracting Officer. Request for final payment will not be approved until the marked drawings are delivered to the Contracting Officer.

2.9 OPERATION AND MAINTENANCE MANUAL

When required by Task Order furnish an operation and maintenance (O&M) manual for each system (discipline) identified. Each manual shall be bound in a standard 8-1/2" x 11", 3 ring, loose leaf, and hardcover binder.

The manual shall contain, as a minimum, the following:

The manufacturer and local representative's name, address, and telephone number.

Catalog sheets, model numbers, and other descriptive literature for each system component.

Instructions for installation, connection, start-up, operation, shutdown, troubleshooting maintenance, lubrication, and overhaul for the items specified in the Task Order.

Exploded or other detailed views of all components shall be included with complete parts list and ordering instructions.

Other items may be required, and defined in Task Orders.

2.10 INSTRUCTION TO GOVERNMENT PERSONNEL

When required by the Task Order, the contractor shall furnish the services of a competent instructor to give full instructions to designated government personnel in the adjustment, operation/maintenance, and safety requirements of all equipment/systems installed. Submit a proposed outline and time requirements for approval. Training shall include hands on experience whenever necessary to ensure full understanding by participants. Instructions shall cover installation, connection, start-up, operation, shutdown, troubleshooting, maintenance, lubrication, overhaul operations and emergency procedures at a minimum and include any other topics required to provide personnel with a full and complete understanding of the equipment/systems.

Each instructor must be thoroughly familiar with all parts of the installation and trained in operating theory as well as practical operation and maintenance work. Use manufacturer's representatives where practical. Instructors will use approved O&M manuals as reference material during training. Coordinate scheduling of instructions with the Project

Manager (PM), Contacting Officer Representative (COR) and/or Point-of-Contact (POC). Unwitnessed instructions or instructions given to non-designated personnel will not constitute compliance with these requirements. Provide all instructions in conjunction with the Final Inspection and submit the attendance list immediately following instruction.

2.11 PROJECT MANAGER

It shall be the responsibility of the contractor to provide a responsible project manager to represent the contractor in all matters pertaining to work under this contract. The project manager shall have the responsibility of overall supervision, quality control, cost estimating and be responsible for the management of all ongoing work. S/he shall be available in person, by telephone, or radio to respond to any and all problems during normal working hours.

The contractor shall provide a detailed resume of project manager for review and approval by the Contracting Officer. If during the term of this contract, the contractor changes or replaces the project manager, approval by the Contracting

Officer is required.

2.12 SITE SUPERINTENDENT

It shall be the responsibility of the contractor to provide a responsible site superintendent to represent the contractor in the field in all matters pertaining to individual Task Orders under this contract including, but not limited to construction, day-to-day coordination of activities, control over employees and subcontractors, and coordination with local Government personnel. The site superintendent may also be designated the project manager. S/he shall be available on site in person, by telephone, or radio to respond to any and all problems during normal working hours.

It is expected that this individual will be available on site for at least three (3) hours per workday unless otherwise indicated in Task Order. The skills and qualifications of the designated site superintendent for each Task Order will be part of each Task Order submittal and negotiations. The site superintendent shall be responsible for on-site Quality

Control and shall sign all Task Order submittal transmittal sheets. Site superintendent shall maintain on site a file containing the following project documents when applicable.

□ Executed Task Order (Task Order Request, Price Proposal)

□ Contract Drawings

□ Contract Specifications

□ Quality Control Plan – (up to date)

□ As-Built Drawing – (up to date) if required

□ Task Orders

□ Modifications

This file shall be maintained and available to the Contracting Officer upon request. If the Site Superintendent is replaced, the existing Superintendent shall review all documents and ongoing issues with the new Superintendent. The Contracting

Officer shall be invited to participate in the review.

3.0 IDIQ ORDERING PROCEDURES

3.0.1 Description of Agreement

The contractor shall furnish the products/services as required in the SOW, if and when requested by the

Contracting Officer (CO) as specified in the individual Task Orders.

3.0.2 ID/IQ Period of Performance (Anticipated)

Base Period Date of Award or April 10, 2018 whichever is later through March 31, 2019

Option Period One (1) – April 1, 2019 through March 31, 2020

Option Period Two (2) – April 1, 2020 through March 31, 2021

Option Period Three (3) – April 1, 2021 through March 31, 2022

Option Period Four (4) – April 1, 2022 through March 31, 2023

Individual Task Orders will have individual Period of Performances determined at time of award.

3.0.3 Pricing

The pricing shall be determined on Task Order basis.

3.0.4 Extent of Obligation

The IDIQ Contract does not obligate any funds. Funds will be obligated on individual USDA – FS – Task

Orders.

3.0.5 Purchase Limitation

Each individual Task Order maximum is $150,000.00. The minimum purchase limit shall be $2,000.00.

3.0.6 Individuals Authorized to purchase under the ID/IQ

Only a warranted CO/PA assigned to Region 8 AQM - is authorized to issue Task Orders under this IDIQ.

3.0.7 Delivery

Delivery/Completion shall be in accordance with the individual USDA – FS and conditions listed in Task

Order.

3.0.8 Administration

R8 AQM is the only organizational element under the USDA authorized to place Task Orders under this ID/IQ

Contract, and is responsible for all administration and overall concerns.

3.0.9 Ordering Procedures

1. Task Orders will be placed against this ID/IQ via email only.

2. Orders may be placed only by a warranted CO/PA in the USDA – FS – Region 8. All orders under this ID/IQ shall be made via a written Task Order (OF-347 or equivalent). A specific, sequential order number shall be included on the order and shall specify the ID/IQ Contract number, as will specific Period of Performance.

3. A new requirement will be sent to the Contractor via email, telephone, or other method that will convey the necessary information. Use of electronic commerce (EC) is encouraged.

4. Contractors will respond by submitting technical specifications and pricing for the proposed requirement via e-mail to the requesting CO/PA.

5. Evaluations of proposals will normally be based solely on price, however individual requests maybe be evaluated on price and other factors identified in the request.

6. Based on a review of the Contractor's response and any necessary clarifications, the CO/PA will issue a written

Task Order award (OF-347, SF-1442 or equivalent) to the Contractor via email.

7. Ordering Thresholds Task Orders will be placed against this ID/IQ by the USDA – FS – R8 Office organizational elements in accordance with the following: Competition was established through RFP process of the base ID/IQ, and competition will be used with all ID/IQ contract holders based on Competition Threshold

Sources Sought stated below:

<$25,000.00 Single Source ID/IQ Holder - Requirements estimate at less than $25,000, the

Government may propose a single IDIQ holder to receive the requirement.

>$25,000.00 All ID/IQ Holders - If the requirement estimate exceeds $25,000, then all ID/IQ holders will receive the requirement for proposal/quote.

Any services deemed an emergency by the Government may result in a single source award to any of the ID/IQ holders regardless of value.

8. Ordering Exceptions Exceptions to the Ordering Procedures are listed below.

- The need for such services is of such urgency that providing such opportunity would result in unacceptable delay.

- Only one awardee is capable of providing the services required at the level of quality necessary because the services ordered are unique/specialized.

9. Award of Task Orders

Task Order will primarily be awarded based on price. However, induvial task orders may include evaluation factors other than price. Task Orders issued under any resulting ID/IQ will include the following information as applicable:

(1) ID/IQ Contract Number and Delivery/Task Order number;

(2) Date of the order;

(3) Description of the products/services to be performed;

(4) The work Schedule, period of performance, or required completion date;

(5) Place of delivery or performance;

(6) Deliverables;

(7) Line item number and description, quantity, unit price and extended total;

(8) Accounting and appropriations data.

3.0.10 Order of Precedence

All the terms and conditions of the base ID/IQ will be incorporated and apply to all resulting Task Orders. In the event of an inconsistency between the provisions of a specific Task Order, the provisions of the contractor ID/IQ will take precedence unless otherwise determined by the CO. All disputes regarding the individual Task Orders are to be referred to the ID/IQ CO.

3.1 BIOBASED AND SUSTAINABLE PRODUCTS

The Contractor must comply with the Agricultural Act of 2014; the Food, Conservation and Energy Act of 2008 (FCEA), 7 U.S.C. 8102; the Farm Security and Rural Investment Act of 2002 (FSRIA), 7 U.S.C. 8102; the Federal Acquisition

Regulation; Executive Order (EO) 13514, “Federal Leadership in Environmental, Energy and Economic Performance,” dated October 5, 2009; EO 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” dated January 24, 2007; and Presidential Memorandum, “Driving Innovation and Creating Jobs in Rural America through Biobased and Sustainable Product Procurement,” dated February, 2012 to provide biobased products.

All supplies and materials shall be of a type and quantity that conform to applicable Federal specifications and standards, and to the extent feasible and reasonable; include the exclusive use of biobased and recycled products.

3.2 DEFINITIONS (Not included in Federal Acquisition Regulations)

Wherever in these provisions, or in other contract documents, the following terms, or pronouns in place of them, are used, the intent and meaning shall be interpreted as follows:

2-Cycle Engine Oils - Lubricants designed for use in 2-cycle engines to provide lubrication, decreased spark plug fouling, reduced deposit formation, and/or reduced engine wear.

Adhesive and Mastic Removers - Solvent products formulated for use in removing asbestos, carpet, and tile mastics as well as adhesive materials, including glue, tape, and gum, from various surface types.

Agricultural Spray Adjuvants - Products mixed in the spray tank with the herbicide, pesticide, or fertilizer formulas that will improve the efficiency and the effectiveness of the chemicals, including sticking agents, wetting agents, etc.

Asphalt Restorers - Products designed to seal, protect, or restore poured asphalt and concrete surfaces.
