(ix) FAR 52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021) (Provision)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation represents the lowest priced technically acceptable quoter. Award will be made on the basis of the lowest evaluated price of quotes meeting or exceeding the acceptability standards for Technical Acceptability. The following factors shall be used to evaluate offers:

• PRICE

• TECHNICAL ACCEPTABILITY

(b) Options. As part of price evaluation, the government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one half of the offeror’s final option period price to the offeror’s total price (base and four option periods). Thus, the offeror’s total price for the purpose of evaluation will include the base year, 1st option and 2nd option period, 3rd option period, 4th option period, and ½ of the 4th option period price. Offerors are not required to enter a price for the potential six-month extension period.

(c) BASIS FOR CONTRACTACT AWARD. This is a competitive lowest priced technically acceptable basis, utilizing simplified acquisition procedures in accordance with FAR Part 13.

(d) PRICE EVALUATION. The price evaluation will document the reasonableness and affordability of the proposed total evaluated price. Affordability may be controlled in circumstances where the superior offeror is at a cost that the Government cannot afford.

The Government reserves the right to conduct a price realism evaluation to assess an offeror’s low fixed price. If conducted, a determination will be made whether the low price reflects a lack of understanding of the contract requirements. Vendors submitting unrealistically low pricing may be excluded from the competition.

(e) TECHNICAL ACCEPTABILITY. The technical evaluation will consider all information provided by Offerors in the Technical submission. Evaluations will document that the Quoter represents an acceptable level of understanding of, and planned approach to successfully performing all requirements under this contract. Contractor must have administrator access to the controls software to allow calibration and changes to control sequences and settings. Only quotes determined to be reasonable, balanced, and affordable will be evaluated for technical acceptability.

ALL QUOTERS MAY NOT HAVE TECHNICAL SUBMISSIONS EVALUATED

THE GOVERNMENT RESERVES THE RIGHT TO AWARD TO OTHER THAN THE
