About this file
This document contains a federal contract solicitation and related questions and answers. The solicitation is seeking a contractor to provide initial title examination, chain of title documentation including copies of deeds, preliminary title commitments, copy fees, and administrative expenses for 13 properties located in Maine and New Hampshire. The properties include tracts owned by White Pine Forest, LLC, Bayroot, LLC, and Penley & Mills, Inc., as well as easements over lands owned by Ruth Moscovitch Trust, Vinton Thompson Trust, and First Mag 7 Family Limited Partnership. The solicitation is being issued by the United States Department of Agriculture Forest Service Eastern Region. The accompanying questions and answers clarify that the government expects the contractor to search back to the original parcel creation date on each property if difficulties arise in the standard 60-year search period, utilizing public records as needed.

1. The language in the Statement of Work says “All work shall meet current ALTA USA Department of Justice Title Standards with the exception that chains-of-title will be brought back to the creation of the parcel if possible.”
Typical search periods and the accompanying chains-of-title (deeds) for the DOJ Title Standards is 60 years. Therefore, please clarify if the government is expecting the contractor to conduct the search back to patent on each parcel.
A. Yes, the government is requesting additional title search/chain-of-deeds beyond the 60-year requirement to original parcel creation, should difficulties arise the expectation is limited to public records (registry, probate other gov. offices).
