About this file
This document is a solicitation issued by the U.S. Department of Agriculture Forest Service for a Multiple-Award Task Order Contract (MATOC) for Invasive Species/Rare Plants Vegetation Management Services. The contract will have a base period of one year with four one-year option periods, for a total of five years.
The services required include surveying, inventorying, controlling, and monitoring invasive species infestations and rare plant populations on various National Forests and Bureau of Land Management field offices in southern Idaho. Multiple awards will be made, and contractors will compete for individual task orders. Mandatory requirements for the solicitation include submitting a completed SF-1449 form, pricing schedule, representations and certifications, and registration in the System for Award Management (SAM) database. Award will be based on best value considering past performance, potential impact on other orders, and price, unless an urgent need or logical follow-on to a previous order applies. Key personnel and quality control requirements are specified, along with applicable FAR clauses and federal labor laws.

• One hundred percent compliance with the post-treatment efficacy monitoring requirements of the individual Task Order.
2.3 Means of Measurement Compliance with quality and performance standards and achievement of acceptable quality levels will be among the factors that contribute to the contractor’s performance evaluation.
Task/Critical Subtask E.2.3.1 - Quality Control Plan Contractor’s Quality Control Plan containing all necessary components shall be submitted to the CO and COR at the pre-work meeting(s). Measurement includes review for these necessary components and efficacy of plan components.
Task/Critical Subtask E.2.3.2 – Key Personnel Contractor shall identify Key Personnel with the necessary skills, experience, qualifications, and certifications required for an individual Task Order. Key personnel shall be identified when providing quotes for an individual Task Order and shall be confirmed with the CO and COR at the pre-work meeting(s).
Measurement includes checks for presence of and satisfactory performance by key personnel on the specifications of the individual Task Order.
Task/Critical Subtask E.2.3.3 - Herbicide Application A determination of successful execution of the contract will be based on either randomly located transects within each treatment area that are representative of the treatment area or, where feasible, an inspection of the entire treatment area. Tolerances will be determined by the COR based on these inspections.
The use of indicator dye is required to assist the Contractor, and Contractor Inspectors, COR, and Government Technical Monitors in determining application coverage. Concentrations of indicator dye will be specified by the COR. Coverage inspections may be conducted separately from mortality inspections.
Solicitation No.: 1240LS24R0002
Indications of herbicide application and incipient mortality will be evident by visual deterioration of the treated plants beyond recovery. Indicators would include two or more of the following: drooping and wilting, chlorosis, interrupted seed maturation, and/or drying of plant parts (stem, leaves, reproductive parts).
As part of the inspection:
• The COR will request and inspect treatment application records for completeness and accuracy; this may occur daily if deemed necessary by the COR. Incomplete or inaccurate records will not be accepted and any invoices submitted for payment prior to correcting application records will be rejected.
• It can take up to three weeks for treated plants to develop signs of herbicide damage. Therefore, enough time needs to lapse between the treatment and the inspection to determine treatment efficacy. The work for a Task Order will not be accepted until at least 90% of the invasive plants show signs of herbicide damage. The COR and Technical Monitors will conduct random, periodic inspections for coverage and mortality beginning approximately 5-10 days after herbicide has been applied to an area and continuing weekly to bimonthly thereafter as needed.
• Non-target damage will also be assessed during inspections. The work will not be accepted if more than 10% of desirable non-target plants have impacts that are not recoverable within two years. Inspection of dye patterns, herbicide injury, treatment records, and inventory data may be used to help determine if an overapplication has occurred. Areas treated in the fall may not show herbicide effects until the following spring or summer. Therefore, on fall treatments, payment will be made based on the proper application and coverage of the herbicide and final inspection for mortality will take place the following summer. If it is determined that at least 90% of the invasive plants were not damaged, a meeting with the Contractor, the CO and the COR will be held to discuss retreatment at the Contractor’s expense.
• The COR will conduct random, periodic inspections for compliance with USFWS or NMFS consultation requirements for the application of herbicides where Endangered Species Act listed species may occur (see individual Task Order).
• In addition, the Idaho State Department of Agriculture may conduct periodic use inspections of the herbicide application operation. These use inspections will cover application technique, application rates, and adherence to pesticide use rules (refer to ISDA Use Inspections Exhibit).
• If, based on the results of the Idaho State Department of Agriculture use inspection, and deemed necessary by the COR, specimens of the target invasive plant species, desirable non-target plants, soil, or random samples of the herbicide solution from the Contractor’s spray tanks may be obtained for laboratory analysis. The specimens or soil samples would be analyzed to determine that the required herbicide and rate were applied. The herbicide solution sample would be analyzed to determine that the required strength was mixed. The Contractor may observe the sampling and may request a copy of the laboratory analysis.
Task/Critical Subtask E.2.3.4 – Post-Treatment Efficacy Monitoring
• The COR will request and inspect treatment efficacy monitoring records for completeness and accuracy;
this may occur daily if deemed necessary by the COR. Incomplete or inaccurate records will not be accepted and any invoices submitted for payment prior to correcting monitoring records will be rejected.
2.4 Penalties
Prorated payment down to 90%. Payment will be matched to achieved tolerances between 90% and 95%.
Tolerances below 90% constitute grounds for contract termination based on failure to perform and payment will not be made. If not corrected, these defects shall constitute grounds for termination for failure to perform and payment shall not be made.
The following penalties for non-compliance shall apply:
Task/Critical Subtask 2.4.1. - Quality Control Plan
• Contractor shall not start work until the quality control plan has been submitted to and approved by the
COR. Delays in starting work may affect full payment when it is determined by the CO and the COR that the Contractor’s delay has caused them to miss the most efficacious treatment period and therefore resulted in less-than-optimal control of the target species.
Task/Critical Subtask 2.4.2. – Key Personnel Key personnel are a critical component for successful implementation and completion of every Task Order.
• Therefore, if deficiencies in Key Personnel are not immediately corrected, a Stop Work order will be applied.
• A failure to provide Key Personnel is a defect that shall constitute grounds for termination for failure to perform and payment shall not be made.
Task/Critical Subtask 2.4.3 - Herbicide Application
• If inspections indicate that quality and performance standards and acceptable quality levels have not been met, the contractor may be required to rework the area at no cost to the Government. The Government reserves the right to determine re-treatment schedules and application rates.
If inspections and/or laboratory analysis indicate that desirable non-target damage requirements have not been met, payment to the contractor may be reduced by up to $600 per acre over which the damage occurred to cover the cost of revegetation.
• In the event the laboratory analysis concludes that the required herbicide was not applied to the target invasive plant species or that the herbicide solution does not comply with requirements, the Contractor shall be given one week to correct the deficiency by re-treating the area at no cost to the government.
• Non-compliance with quality and performance standards and acceptable quality levels constitutes grounds for contract termination based upon failure to perform.
Task/Critical Subtask 2.4.3 – Post-Treatment Efficacy Monitoring Post-treatment monitoring is a crucial component of invasive plant control. It is necessary to track the response of invasive plants in terms of cover, density, and distribution as a response to treatment.
• One hundred percent compliance with monitoring requirements is mandatory. Incomplete or inaccurate records that have not been corrected by the Contractor will result in less than full payment to the Contractor’s due to reduced value to the Government of the Contractor’s Deliverable Products.
• Non-compliance with quality and performance standards and acceptable quality levels constitutes grounds for contract termination based on failure to perform.
