SECTION C – DESCRIPTION OF REQUIREMENTS

Rocky Mountain Region Vegetation Mapping Updates Performance Work Statement (PWS)

May 2021

Overview

This is a base plus four one-year options indefinite-delivery, indefinite-quantity (IDIQ) contract for Vegetation Mapping Updates in the Forest Service Rocky Mountain Region (Region 2).

One contract will be awarded from this solicitation. This award will be set aside for total small business under NAICS 541370. Offerors must submit prices for all items. See Section 52.212-2 for instructions for proposal preparation. This contract has been developed for the Rocky Mountain Region.

The work for all Region 2 Forests is estimated at $2,500,000 but in case new needs arise from future fires, etc, the ceiling for this IDIQ is $4,000,000.00. (AGAR 452.216-73)

Per FAR 16.504 (a)(1) the minimum guarantee of $1,000 will be met with this issuance of the first task order, concurrent with award of the IDIQ.

Proposals shall be valid for 60 days after the date of receipt for the solicitation. If additional time is needed, an extension will be requested. Refer to Instructions to Offerors (RFP page 23) on preparing your proposal and pricing.

Background

The Rocky Mountain Region (Region 2) uses NRM FSVeg Spatial as the corporate database of record for existing vegetation. This spatial layer needs to be updated due to recent large-scale fire events, management activities, tree mortality from insects and disease, or other causes. The purpose of the project is to re-delineate and/or re-attribute FSVeg Spatial polygons that no longer represent current conditions on the ground using current imagery and ancillary field data. As such, we are interested in contractors who are skilled in aerial photo interpretation, are familiar

1240LP21R0004 Page 5 with the flora in the Rocky Mountains in order to correctly identify major tree and shrub species, are skilled in ArcGIS, and have practical knowledge of the Forest Service NRM Field Sampled Vegetation (FSVeg) and FSVeg Spatial Applications.

Scope of Work

The scope of the work is to re-delineate, and/or re-attribute FSVeg Spatial polygons that no longer represent current conditions on the ground using current imagery, and ancillary field data such as a Stand Exam point summary layer and past harvest information. The scope may be a combination of re-delineation and re-attribution or it may be strictly re-attribution.

In some circumstances, linked Common Stand Exam points (FSVeg/FSVeg Spatial), may need to be archived where they no longer represent current vegetation. Points may be re-assigned to new polygons.

Once polygons have been re-delineated and/or re-attributed, the GIS calcs tool in FSVeg Spatial will be run and Tool 10 on the R2 Toolbar will be used to calculate Region 2 specific attributes.

Areas to be updated will be identified by the Forest Service. Across the Region approximately 2 million acres need to be updated. The project area size will vary on each National Forest. When necessary, to verify attribution calls, the Forest Service will conduct field inspections on up to 1.5% of the acres.

Deliverables/Reporting Requirements

Deliverable #1 (An updated FSVeg Spatial database, submitted via multiple check-outs, with re-delineated and/or re-attributed polygons as defined in each Task Order): Re-delineated polygons will have no gaps or overlaps.

Linked Common Stand Exam points (FSVeg/FSVeg Spatial), will be archived where they no longer represent current vegetation. Points may be re-assigned to new polygons. Once polygons have been re-delineated and/or re-attributed, the GIS calcs tool in FSVeg Spatial will be run to calculate Aspect Class, Elevation (ft), and Slope (%). After GIS calcs are run, Tool 10 on the R2 Toolbar will be used to calculate Region 2 specific attributes and flag any errors. Any errors will be corrected and Tool 10 will be run again until the data are error free.

The updated FSVeg Spatial database checkouts will be posted on the Forest Service T drive in a location specified by the Forest Service after task award.

Inspection/Acceptance/Payment

Forest Service will inspect the contract deliverables using the Quality Assurance Surveillance Plans (QASPs) found at Attachments 2 and 3. Payment will be reduced based on the formulas for errors in the final deliverables as identified in the QASPs.

Government Property

Contractor-Assigned Government Furnished Property (GFP): The Government will provide GFP to the contractor on a rent-free basis for use of performance on this contract. The contractor shall establish, maintain, and implement a property management and control program in accordance with FAR Part 45 and the GFP clauses in the contract. The contractor shall maintain and update a listing of the GFP in their possession and allow the Government access to any GFP reports during the performance of the contract. GFP used in the conduct of this contract is under the control and accountability of the contractor. Contractor personnel are responsible for protecting, preserving, maintaining, and repairing any GFP in their possession according to the contract and their property control procedure. The contractor shall be liable for any and all loss or damage of GFP until transfer of property back to the Government occurs. The Government will provide the following GFP:

Approximately 1 FS imaged laptop with ArcMap, FSVeg Spatial, R2 Tools toolbar, and

NRM client installed and an ArcGIS license checked out. This configuration would allow the contractor to work independent of the USFS network if needed, but still requires a USFS User Profile and LincPass for login access to the PC. The FSVeg Spatial Application can be run on PCs that have ArcGIS 10.5.1 or greater and the FSVeg Spatial Client Install package loaded.

• FSVeg Spatial check-outs for editing necessary Digital Elevation Models (DEMs) for running GIS calculations.

• User guides for FSVeg Spatial and R2 FSVeg Spatial toolbar

• Geodatabase with feature classes identifying areas to be updated

• Ancillary field data to help with attribution

(d) Comptroller General Examination of Record. 52.216-18 Ordering (AUG 2020)

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from _contract award___ through __July 31, 2026_______ [insert dates].

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c) A delivery order or task order is considered “issued” when—

(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the Government deposits the order in the mail;

(2) If sent by fax, the Government transmits the order to the Contractor's fax number; or

(3) If sent electronically, the Government either—

(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the Contractor; or

(ii) Distributes the delivery order or task order via email to the Contractor's email address.

(d) Orders may be issued by methods other than those enumerated in this clause only if authorized in the contract.

(e) The contractor will be sent task orders identifying the area to be updated with the required acres at the established unit prices in this IDIQ, unless the contractor agrees to a lower price.

52.216-19 Order Limitations (Oct 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than __$2,000___________ [insert dollar figure or quantity], the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor—

(1) Any order for a single item in excess of _$1,000,000____________ [insert dollar figure or quantity];

(2) Any order for a combination of items in excess of __$1,000,000____________ [insert dollar figure or quantity]; or

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within __5___ days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

52.216-22 Indefinite Quantity (Oct 1995)

(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the “maximum.” The Government shall order at least the quantity of supplies or services designated in the Schedule as the “minimum.”

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period;

provided, that the Contractor shall not be required to make any deliveries under this contract after __July 31, 2027_____________ [insert date].

Contractor employees may be barred by the Government from performance of work should they be found ineligible or to have lost eligibility for a USDA LincPass. Failure to maintain a sufficient workforce of employees eligible for a USDA LincPass may be grounds for termination of the contract.

(e) The contractor shall insert this clause in all subcontracts when the subcontractor is required to have routine unaccompanied physical access to a Federally-controlled facility and/or routine unaccompanied access to a Federally-controlled information system.

(f) The PIV Sponsor for this contract is a designated program point of contact, which in most cases is the COR, unless otherwise specified in this contract. 452.216-73 Minimum and Maximum Contract Amounts (FEB 1988)

During the period specified in FAR clause 52.216-18, ORDERING, the Government shall place orders totaling a minimum of $1,000 , but not in excess of $4,000,000 .

452.237-75 Restrictions against Disclosure (FEB 1988)

Data Rights – General

1. The contractor will treat all deliverables under the contract as the property of the U.S.

Government for which the Government Agency has unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest.

2. The contractor will not create or maintain any records that are not specifically tied to or authorized by the contract using Government IT equipment and/or Government records.

3. The contractor will not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected by the Freedom of Information Act.

4. The contractor will not create or maintain any records containing any Government Agency records that are not specifically tied to or authorized by the contract.

5. The Government Agency owns the rights to all data/records produced as part of this contract.

6. The Government Agency owns the rights to all electronic information (electronic data, electronic information systems, electronic databases, etc.) and all supporting documentation created as part of this contract. Contractor will deliver sufficient technical documentation with all data deliverables to permit the agency to use the data.

7. The contractor agrees to comply with Federal and agency records management policies, including those policies associated with the safeguarding of records covered by the Privacy Act of 1974. These policies include the preservation of all records created or received regardless of format [paper, electronic, etc.] or mode of transmission [e-mail, fax, etc.] or state of completion [draft, final, etc.].

8. No disposition of documents will be allowed without the prior written consent of the contracting officer. The agency and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. Records may not be removed from the legal custody of the agency or destroyed without regard to the provisions of the agency records schedules.

9. The contractor is required to obtain the contracting officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, this contract. The Contractor (and any sub-contractor) is required to abide by Government and agency guidance for protecting sensitive and proprietary information.

10. The contracting officer needs to inform contractors of their responsibilities regarding records management if the contract involves access to agency records.

Records Management

As stated in DR 3099-001, Contractors must certify that all Federal records, regardless of media, have been identified and transferred to the appropriate records management liaison or custodian.

Attached Form AD-3001, Documentary Materials Removal/Non-Removal Certification and Non- Disclosure Agreement, shall be completed upon contract completion. The unauthorized removal, concealment, falsification, mutilation, or disposition of official records is prohibited by law and is subject to penalty (18 U.S.C. 2071).

Definition of Federal Records: All books, papers, maps, photographs, machine-readable materials, or other documentary materials, regardless of physical form or characteristics, that are made or received by an agency of the United States Government under Federal law or in connection with the transaction of public business, and that are preserved or appropriate for preservation by that agency or its legitimate successor as evidence of the organization, functions, policies, decisions, procedures, operations, or other activities of the Government or because of the informational value of data in them. (44 U.S.C.3301) Electronic communications such as electronic mail messages are included in this definition.
