About this file

This file is a Buy American Act (BAA) procurement waiver determination and approval package for laboratory equipment. The United States Department of Agriculture (USDA), Agricultural Research Service (ARS), National Center for Aquacultural Utilization Research (NCAUR), Bioenergy Research Unit (BRU) in Peoria, Illinois submitted a nonavailability waiver request on April 20, 2026 (Solicitation #1232SA26Q0217, IAS Requisition #1162866) for 12 bioreactor 2-liter autoclavable glass vessels and required parts compatible with Sartorius Biostat-B Bioreactor Control Units. The estimated procurement value is $69,000.00, with a performance period of April 1, 2026 through May 18, 2026. The product is classified under NAICS 334516 (Analytical Laboratory Instrument Manufacturing) and PSC 6640.

The waiver was approved as justified under FAR 25.103(b)(2) based on comprehensive market research demonstrating nonavailability of compatible equipment manufactured in the United States. The USDA and contracting activity office researched seven alternative vendors and found none offering comparable bioreactor vessels compatible with the Sartorius Biostat-B control units already in use. A Sources Sought announcement was posted on SAM.gov from March 19-23, 2026, and searches of the Federal Procurement Data System yielded no domestically manufactured alternatives. The vessels must maintain specific inner dimensions (130mm diameter, 240mm height) to ensure continuity with 20 years of historical experimental data. The standard BAA provision for domestic price preference will be included in the solicitation. The waiver received required OMB Made in America Office approval on April 27, 2026, from Lara Emmons, Procurement Analyst, and was signed by USDA contracting officers and the Head of Contracting Activity (Acting).
