E.2. CONTRACTOR PERFORMANCE ASSESSMENT REPORT

During the life of this contract, Contractor performance will be evaluated on an interim and final basis pursuant to FAR Subpart 42.15. The Contractor Performance Assessment Reporting System (CPARS) will be utilized for these reviews.

Information on CPARS can be located at http://www.cpars.csd.disa.mil/cparsmain.htm.

E.3. QUALITY ASSURANCE & SURVEILLANCE PLAN (QASP)- PERFORMANCE SUMMARY METRICS

E.3.1. INTRODUCTION

This Surveillance Plan (SP) has been developed to evaluate contractor actions while implementing the PWS. It is designed to provide an effective surveillance method of monitoring contractor performance for each listed deliverable. By employing a fully developed SP, the government and the contractor achieve an understanding of performance expectations and how performance will be measured against those expectations.

The SP provides a systematic method to evaluate the services the contractor is required to furnish.

This SP is based on the premise the government desires to maintain a quality standard in support services and that the contractor can provide the service is the best means of achieving that objective.

The contractor, not the government, is responsible for management and quality control actions to meet the terms of the contract. The role of the government in quality assurance is to ensure contract standards are achieved.

The contractor is required to develop a comprehensive program of inspections and monitoring actions. The first major step to ensuring a self-correcting contract is to ensure that the quality control program approved at the beginning of the contract performance provides the measures needed to lead the contractor to success.

Once the quality control program is approved, careful application of the process and standards presented in the remainder of this document will ensure a robust quality assurance program.

https://www.acquisition.gov/far/index.html http://www.cpars.csd.disa.mil/cparsmain.htm

E.3.2. EVALUATION METHODS

The methods of evaluating contractor compliance may vary depending on the requirements specified by the PWS. The Contracting Officer’s Representative is responsible for selection of the method(s) to be used and the specific detailing of the method(s).

E.3.3. SURVEILLANCE PLAN AND DELIVERABLES

See Attachment A (PWS) 5.2 and 8.0.

E.3.4. PERFORMANCE CRITERIA

E.3.4.1. ACCEPTABLE PERFORMANCE AND INCENSTIVES

Acceptable performance meets the specified standard and does not exceed the allowable deviation. The government may conduct trend analysis of surveillance results to increase or decrease the level of surveillance for specific requirements or provide others incentives (i.e., guaranteed option execution).

E.3.4.2. UNACCEPTABLE PERFORMANCE AND DISINCENTIVES

Unacceptable performance does not meet the specified standard and exceeds the allowable deviation. The government may, if the contractor fails to provide performance at the allowable deviation for any two consecutive months, penalize the contractor’s next invoice by deducting a negotiated amount (percentage) from that invoice or agree on a disincentive (i.e., increased deliverables through a corrective action plan).

E.3.4.2.1. UNACCEPTABLE PERFORMANCE ADMINISTRATION

The Contracting Officer’s Representative shall forward an official email request to the Contracting Officer for an official determination.

The Contractor is put on notice that after performance begins, the Contractor is responsible for paying employees at least the applicable wage determination rate, if one exists, for the place of performance. The Department of Labor strictly enforces the Service Contract Act for all employees covered by the Act.

The above referenced Wage Determination Number is for the Pennsylvania County of Franklin geographical area. If the place of performance is other than this geographical area; and therefore changes this Wage Determination Number the award will include the appropriate revised number, as necessary.

Service Contract Age Wage Determinations can be found at http://www.wdol.gov/.

H.3. SECURITY

Performance of work will require access to classified information or equipment. DD 254, DOD Contractor Security Classification Specification, is required. Some employees will require access to the LEAD's IT network to reference technical manuals, part information, etc. LEAD security requirements mandate that access to the network domain will be limited to U.S. Citizens only. Approximately 30% of the contractor personnel workforce will require SECRET clearance. This will vary by cost center assigned and job classification. All other contractor personnel require a security background check (NACI).

In accordance with the DD254, certain contractor employees shall be required to have a Common Access Card (CAC). The contractor shall coordinate the issuance of CAC's in conjunction with LEAD Security Personnel and the COR. The Contractor will be compensated for the employee's time during the issuance of CAC's.

Employees operating their personal vehicle on LEAD shall have the appropriate vehicle security identification. The employee is responsible for obtaining this identification through depot security. The contractor will not be compensated for the employee's time during the issuance of vehicle security identifications.

The contractor shall ensure compliance with all applicable security regulations, and all Government security operations requirements, for facility access, and handling of materials.

Contractor personnel must comply with local security requirements for entry and exit control for personnel and property at the government facility.

The contractor personnel shall be responsible for safeguarding all Government property, at the close of each work period, government facilities, equipment, and materials shall be secured.

The contractor personnel shall apply the provisions and limitations of Freedom of Information Acts.

This requirement and all materials provided to the contractor by the government and results, conclusions and recommendations obtained thereof are considered confidential in nature and are to be treated with the same level of care that the contractor treats its own confidential business information. The information shall not be disclosed, copied, modified, used (except in completion of the requirement) or otherwise disseminated to any other person or entity at any time to include, but not limited to inclusion in any database external to the Government without the government’s express consent.

H.4. NON-PERSONAL SERVICES

(a) As stated in the Office of Federal Procurement Policy Letter 92-1, dated September 23, 1992, Inherently Governmental Functions, no personal services shall be performed under this contract. No contractor employee will be directly supervised by the government. All individual employee assignments, and daily work direction, shall be given by the applicable employee supervisor. If the contractor believes any government action or communication has been given that would create a personal services relationship between the government and any contractor employee, the Contractor must promptly notify the Contracting Officer of this communication or action.

(b) The contractor must not perform any inherently governmental actions under this contract. No contractor employee shall hold him or herself out to be a government employee, agent, or representative. No contractor employee may state orally or in writing at any time that he or she is acting on behalf of the government. In all communications with third parties in connection with the contract, contractor employees must identify themselves as contractor employees and specify the name of the company for which they work. In all communications with other government contractors in connection with this contract, the contractor employee must state that they have no authority to in any way change the contract and that if the other Contractor believes this communication to be a direction to change their contract, they should notify the Contracting Officer for that contract and not carry out the direction until a clarification has been issued by the Contracting Officer.

(c) The contractor must insure that all of its employees working on this contract are informed of the substance of this clause. Nothing in this clause limits the government's rights in any way under any other provision of the contract, including those related to the government's right to inspect and accept the services to be performed under this contract. The substance of this clause must be included in all subcontracts at any tier.
