About this file

This is a Darfur Contracting Act Certification form (DGS PD 1) issued by the California Department of General Services Procurement Division for use in conjunction with IFB 26-3032 for Daily Courier Services at the DDSD Stockton Branch. The form applies to any company with business activities or operations outside the United States within the previous three years. Bidders must certify their compliance status to be eligible to submit proposals for this State of California contract. Companies without international business activities within the three-year period are exempt from this requirement.

The form provides two compliance options for eligible bidders. Option 1 requires companies to certify under penalty of perjury that they are not scrutinized companies as defined by Public Contract Code Section 10476. Option 2 accommodates scrutinized companies that have obtained written permission from the Department of General Services Director to bid on a case-by-case basis when determined to be in the state's best interests, per Public Contract Code Section 10477(b). Bidders must complete the appropriate section with their company name, Federal ID Number, authorized signature, and signatory title and date. The form does not address pricing, set-asides, or other commercial terms.
