About this file

This is a Minority/Women Business Enterprise (M/WBE) Trucking Procedure Compliance document prepared by the Harris County Department of Economic Equity and Opportunity (DEEO) that establishes guidelines for determining when M/WBE trucking companies perform a Commercially Useful Function (CUF) to receive M/WBE contract credit on Harris County projects, including the Greens Bayou Mid-Reach Channel Conveyance Improvements project. The document outlines requirements for M/WBE trucking firms to qualify for credit, including mandatory ownership and operation of at least one truck with dedicated employees as drivers, management and supervision of the entire trucking operation with at least 30 percent of subcontract work performed by the M/WBE's own forces, and avoidance of contrived arrangements. The infographic provides clarity on various operational scenarios, including when M/WBE firms may lease additional trucks from non-M/WBE vendors and the corresponding credit percentages applicable to each arrangement. Vendors must submit required documentation with their M/WBE Utilization Plans, including W-9 forms, current insurance documents, and proof of truck ownership or registration from TxDOT. The DEEO offers courtesy utilization plan reviews upon request submitted up to five business days prior to solicitation closure, though such reviews do not determine plan responsiveness and all documentation must still be formally submitted with bid packages through Bonfire.

The credit structure distinguishes between M/WBE-owned and operated trucks, which receive 100 percent credit toward participation goals, and leased trucks, where credit allocation depends on whether the M/WBE provides its own drivers and the ratio of owned to leased vehicles. For leased trucks exceeding the quantity owned by the M/WBE, only commissions and fees count toward participation goals. All M/WBE trucking firms must be certified through one of Harris County's accepted certifications, and independent contractors cannot be utilized; all drivers must be direct employees. Vendors requiring additional information or assistance with the M/WBE program may contact the Harris County DEEO at 1001 Preston, Suite 670, Houston, Texas 77002, by telephone at (713) 274-1400, or by email at DEEO@eeo.hctx.net, with comprehensive program policy information available on the DEEO website.
