About this file
This is a Request for Proposal (RFP) No. 3837 issued by the Eastern Municipal Water District (EMWD), a water agency serving approximately 1 million people across a 601 square mile service area in western Riverside County, California. The RFP seeks a qualified vendor to standardize and program six (6) Red Lion DA70A Remote Terminal Units (RTUs), operating on Crimson 3.2 software, for EMWD's RTU Upgrade Project. The project aims to ensure consistent functionality, optimal performance, and efficient data management across the system. The proposal submission deadline is August 20, 2025, at 4:00 p.m. PDT, with an anticipated project completion date of December 31, 2025. The vendor selection will be based on criteria including firm qualifications, personnel experience, project approach, references, pricing, and ability to meet insurance requirements.
The compensation for this project will be on a time and expense basis, with the maximum payment to be determined during the proposal evaluation. Proposers are required to submit detailed pricing information, including hourly rates for personnel and any miscellaneous charges. The RFP encourages proposers to offer early payment discounts, which will be considered in the evaluation process. The selected consultant will be responsible for developing standardized configuration templates, setting up communication protocols, creating programming templates for various site types, establishing routine configurations, and providing training to EMWD personnel. The project will involve close collaboration with EMWD's Information Systems department and will require adherence to the district's strict computing and data management policies.

I. Be advised that all information contained in proposals submitted in response to this solicitation may be subject to the California Public Records Act (Government Code Section 6250 et seq.), and information’s use and disclosure are governed by this Act.
J. CONFIDENTIAL/PROPRIETARY INFORMATION
Be advised that all information contained in proposals submitted in response to this solicitation is subject to the California Public Records Act (Government Code Sections 6250 et seq.), and the information’s use and disclosure are governed by this Act. Government Code Section 6250 provides that “access to information concerning the conduct of the people’s business is a fundamental and necessary right of every person in this state.” As such, all proposals and required submittal information may be subject to disclosure to the general public under the California Public Records Act, unless specifically identified as trade secret, proprietary, and/or confidential. Only pages within each proposal and/or submittal that are in fact a trade secret, proprietary, and/or confidential shall be marked as such. EMWD reserves the right to reject any proposal received which does not meet the aforementioned criteria.
Proposers may provide supplemental information they consider to be exempt from public disclosure under the provisions of the California Public Records Act, including asserted “trade secret” information. Such supplemental information shall not be material to the required submittal information and the EMWD shall be under no obligation to consider such supplemental information in its evaluation. Please be advised that any such supplemental information submitted to the EMWD is subject to the California Public Records Act, and may be released by the EMWD as required by the Act, a court order, or other legal process.
If submitting confidential, supplemental information, such information shall be submitted separately from the rest of the submittal and shall be clearly marked "Confidential". Any confidential/proprietary submittals will be considered as exceptions and scored as such in the contractual selection criteria.
The following California Civil Code provision defines “trade secret” as information that:
(1) derives independent economic value, actual or potential, from not being generally known to the public or to other persons who can obtain economic value from its disclosure or use; and
(2) is the subject of efforts that are reasonable under the circumstances to maintain its secrecy.
Additionally, California courts have consistently held that when individuals or businesses voluntarily enter into the public sphere, they diminish their privacy interests. (California State Univ. v. Superior Court (2001) 90 Cal.App.4th 810, 834.)
In the event of litigation concerning the disclosure of information Proposer considers exempt (e.g., Trade Secret, Confidential, or Proprietary) EMWD shall act as a stakeholder only, holding the information until otherwise ordered by a court or other legal process. If EMWD is named in an action arising out of a California Public Records Act request for any information Proposer deems confidential, proprietary, or trade secret, Proposer shall defend at its own expense and indemnify EMWD, its officers, employees, and agents from any and all liability, claims, losses, damages, costs, and expenses, including attorney’s fees, in any such action or proceeding arising under the California Public Records Act.
