Educational Specifications for the Administrative Offices dated April 24, 2023, furnished by the SLAM

Collaborative (the “Educational Specifications”) appended as Exhibit F and Exhibit G, and a

Preliminary Master Project Schedule prepared by Arcadis U.S., Inc., appended as Exhibit H for information and reference purposes only.

The SBC is the school building committee established by the City for the Project.

2. PROJECT BACKGROUND, SCHEDULE, AND BUDGET

As part of the District’s long-term facilities needs planning process, in 2018 the District conducted a long-range facilities study including evaluation of the presently 85-year-old middle school building. It was determined that the existing middle school building has significant physical deficiencies that negatively impact the sufficiency of facility conditions, site safety, and school operations efficiency, including but not limited to compliance issues, a lack of usable outdoor space, safety issues associated with bus and parent drop-off and pick-up layouts, improperly sized classrooms, and shared spaces for the delivery of educational programming. It was ultimately determined that the District needs a new middle school building, and that a larger site would allow the District to build a state-of-the-art new middle school building that meets present-day teaching and learning needs. The long-range facilities study included a study of feasible sites, test-fits, and development of an order of magnitude of costs for a new middle school. The long-range facilities study also determined that building the new middle school on a larger site would provide the necessary space for parking, bus and parent pick-up and drop-off, outdoor athletic facilities, and play areas. The District’s long-range facilities study also identified the need for a more appropriate District central administrative offices facility and determined that building the new middle school on a larger site would allow the District to construct a new central office space as part of the Project.

After a multi-year project planning process, the City and District are proceeding with this Project for the construction of a new Middle School building and grounds which will serve students in grades six through eight, and the new Administrative Office building for the District.

https://portal.ct.gov/das/ctsource/bidboard?language=en_US

The Project will include the new Middle School building that will host grades six through eight, and the new Administrative Offices. The Project will be constructed at 64 and 78 Pulaski Highway. The new

Middle School will serve an eight-year peak projected enrollment of 590 students, will have an estimated gross building square footage of 126,776 square feet, and will be designed such that the new building as-constructed is a new, modern, and educationally sound facility that supports collaborative and interactive learning.

The Administrative Offices portion of the Project will have an estimated gross square footage of 5,681 square feet. The total Project square footage, inclusive of the Middle School and Administrative Offices areas, is estimated to be 132,457 square feet. The building design for the Project will incorporate sustainable energy strategies that can be accommodated within the construction budget of $80 million.

Other key components of the Project are anticipated to include:

• Education design: Flexible and adaptable learning spaces for core classrooms organized by grade and team, including integrated technology, science labs, and special education resource rooms.

• Administrative facilities: Relocation and inclusion of the school district’s administrative offices within the new building.

• Site and infrastructure: 230 parking spaces, a 12-bus loop, and a designated student drop-off area.

• Athletic facilities: Three playing fields (including an all-purpose field with a baseball diamond, a separate softball field, and a practice field), with the potential addition of a regulation track.

• State funding: A school building project priority list grant through CTDAS with a reimbursement rate of 87% for both the Middle School and Administrative Offices portions of the Project, and a full space standards waiver.

The City’s, SBC and District’s key goals for the Project include:

• Incorporation of an innovative design that encourages creative thinking, provides access to new technologies and equipment to engage students and introduce new opportunities.

• Creation of inclusive, inviting and comfortable environments that foster a positive climate and flexible methods of teaching and learning for all.

• Creation of a welcoming neighborhood campus that accommodates a full range of indoor and outdoor extra-curricular and community use functions.

• “Zone” of the new facilities by function to provide clear building organization and safe wayfinding to delineate between academic and gathering/community-use spaces.

• Implementation of net-zero energy strategies to showcase Ansonia’s commitment to sustainability and reduce operational costs, including but not limited to features designed in accordance with the WELL Initiative to create environments that promote the health and wellbeing of the building occupants.

Additional information is provided in the District’s Educational Specifications for the Project.

The project delivery method for this Project will be a “construction manager at-risk” (“CMR”) pursuant to a construction management agreement with a guaranteed maximum price (“GMP”) between the City and the CMR. In addition to engaging the selected Proposer as the Commissioning Agent for the Project, and a construction management firm as the CMR, the City has engaged Tecton Architects, Inc., which, together with its subconsultants, will be the Project design team for the Project (the “Architect”) and will provide all architecture and design services (except those to be provided by other consultants directly engaged by the City and SBC), as well as other project and construction administration services.

The City and SBC have also engaged Arcadis U.S., Inc., as the Owner’s Project Manager and Owner’s

Representative for the Project (the “OPM”).

In addition to the CxA, the CMR, the OPM, and the Architect, the SBC and City intend to engage the following professionals and consultants for the Project: if required for the Project a third-party envelope consultant to review design documents and to perform building envelope inspections and testing; if required for the Project, a third-party independent code consultant; and if required for the Project, a third-party consultant to perform stormwater monitoring and related services. All design professional and consultant services required for the Project, other than services by the CxA, CMR, OPM, third-party envelope consultant, third-party code consultant, and third-party consultant for stormwater monitoring, are anticipated by the SBC and City to be provided by the Architect and its subconsultants, including without limitation, the following to the extent each is required for the Project: structural engineering;

mechanical engineering; electrical engineering; plumbing engineering; fire protection engineering; civil engineering; land survey; landscape design; geotechnical engineering, for services inclusive of inspections of footings, and as needed, for survey and borings consulting; materials testing laboratory and inspection services (during construction); cost estimating; furniture, fixtures and equipment

(“FF&E”) design; lighting design; kitchen food services design; security, technology, data and communications design; acoustical design; and sustainability consulting.

It is anticipated that the Project will be partially funded by a school building project priority list grant from the State of Connecticut through CTDAS, which grant will cover construction costs eligible for grant financial assistance for the construction of both the Middle School and Administrative Offices.

The total Project budget is approximately $100,000,000, and includes the approximate amount of

$80,000,000 for the cost of construction of the Middle School and Administrative Offices, inclusive of potential escalation costs. The portion of the total Project budget allocated to FF&E is approximately

$2,500,000, inclusive of costs for items including but not limited to furniture, fixtures, network equipment, servers, computers, printers, playground equipment and surface and other associated equipment as selected by the SBC and City.

3. SCOPE OF COMMISSIONING AGENT SERVICES

All the Services by the CxA must be provided with the highest level of professional skill, care, and judgment and in compliance with all federal, state, and local requirements. Because the Project will be partially funded by a State of Connecticut school building project grant administered by CTDAS and

OGA, the firm selected as CxA is required to satisfy any requirements and conditions imposed by the

State of Connecticut.

The scope of the Services to be performed and provided for the City, SBC, District and Project by the firm selected as the CxA are those described and required in this RFQ/RFP, including Exhibit A to this

RFQ/RFP and the form of Contract included as Exhibit B to this RFQ/RFP, and include all commissioning services that are usually and customarily performed and provided by a commissioning agent when furnished for the awarding authority and public school district in connection with a project for the construction of a new public school building having a similar or greater scope, magnitude, and complexity as the Project, that is partially funded by a priority list school building project grant administered by CTDAS and provided pursuant to Connecticut General Statutes Chapter 173 and applicable regulations of the State of Connecticut.

The firm selected as the CxA shall be required to work with the Architect, CMR and OPM in all aspects of the design and construction of the Project related to the commissioning of building systems as will be set forth in greater detail in the construction documents for the Project prepared by the Architect and design team. The building systems to be commissioned as part of and in connection with the Services shall include all Project building systems required by the Connecticut High Performance Building regulations, and all Project building systems otherwise specified in Exhibit A to this RFQ/RFP.

The commissioning Services to be provided by the CxA are required to, among other things, measure and verify the quality of the construction of the Project, so as to ensure that the Project building as-constructed meets the intent of the design for the Project. The firm selected as CxA may suggest for consideration by the SBC and OPM changes and improvements to the process(es) for the performance of the Services.

4. TIMING OF PROJECT

See the Preliminary Master Project Schedule appended as Exhibit H (for information and reference purposes only). The present anticipated overall Project schedule includes a standard design, bid, and construct process (with and through the CMR), such that the District can take occupancy of the Middle

School and Administrative Offices beginning in June 2029 prior to and for the beginning of the 2029-

2030 academic year. As of the issuance of this RFQ/RFP, the City and SBC anticipate that all construction documents for the Project building will be completed by the Architect and ready for bidding by the end of November 2027, including all prior estimating, review, approvals by governing authorities, pre-bid conformance review (“PCR”) by CTDAS OGA, and approval by OGA to proceed with bidding by the CMR, except those required for Project technology and FF&E design and procurement. Based on the presently anticipated Project schedule, bidding for the Project elements inclusive of building systems is estimated to begin in or about late November 2027, on-site construction is estimated to begin January 2028, and the Project is anticipated to achieve Substantial Completion by the end of June 2029, to allow for move-in before the beginning of the District’s 2029-2030 school year.

Punchlist and commissioning are anticipated to begin July 2029, with commissioning reaching completion by the end of November 2029. See Exhibit H.

6.2 Selection Process

Evaluation of Submissions in response to this RFQ/RFP will be the responsibility of the SBC.

The selection of a Proposer as the CxA for the Project will be the responsibility of the SBC, subject to the approval of the City’s Board of Aldermen. The SBC and/or City may reject any or all proposals for any reason as the SBC and/or City deem appropriate.

The evaluation and selection process will take place in two stages.

First, the SBC will review all Submissions in response to the RFQ and, based on those

Submissions and the Qualification Criteria described below, the SBC will identify all proposers which they determine to be responsible qualified proposers (the “Qualified Proposers”).

Second, the SBC will open and review the Submissions by the Qualified Proposers in response to the RFP. Submissions in response to the RFP from Proposers who are not identified as a

Qualified Proposer, will be returned unopened to the Proposers. The SBC will evaluate the

Submissions in response to the RFP submitted by the Qualified Proposers, and will determine “at least three of the most responsible qualified proposers” (“Most Qualified Proposers”) using the

Qualification Criteria and the Proposal Criteria set forth below in Sections 7 and 8, respectively, giving due consideration of each Qualified Proposer’s pricing for the Services for the Project, as well as Qualified Proposer’s (i) experience with services of similar size and scope as the Services required for the Project, (ii) organizational and team structure for the Services for the Project,

(iii) past performance data, including, but not limited to, adherence to project schedules and project budgets and the number of change orders for projects, (iv) the approach to the Services required for the Project, and (v) documented contract oversight capabilities. Proposers are encouraged to include in their Submission in response to the RFQ, documentation that provides examples of their work on prior projects having a similar character and image as that desired for this Project by the SBC, City and District.

In its review of Submissions in response to this RFQ/RFP and selection of the firm to be awarded a contract for the Services as the CxA for the Project, the SBC will be guided by the selection of the Most Qualified Proposer that would best serve the interests of the City and

District, and deemed best to provide the Services desired, taking into account cost and the requirements, terms and conditions contained in this RFQ/RFP.

If determined to be warranted by the SBC, the SBC may conduct interviews of the Proposers determined by the SBC to be among the Most Qualified Proposers to assist the SBC in the selection process. If such interviews are to be conducted, the SBC, through the OPM, will include in the interview requests to the Most Qualified Proposers, the name(s) of the member(s) of the SBC who will conduct the interview, and the date by which the Most Qualified Proposer must submit an affidavit disclosing its relationship(s) with the interviewer(s), or, confirming that it has no relationship(s) with the interviewer(s). The names of interviewers will be released solely to enable the Most Qualified Proposer to prepare the affidavit, and neither the Most https://portal.ct.gov/das/ctsource/bidboard?language=en_US

Qualified Proposer nor its representatives shall directly or indirectly contact the interviewer(s) prior to or following the interview process. Key members of each Most Qualified Proposer’s proposed Project team for the Services must participate in the interview and Submission discussion with the SBC, including their proposed Project team members who would likely be interfacing with the SBC, OPM, and District representatives throughout the duration of the remainder of the RFQ and RFP process, and those who would be involved in the performance of the CxA obligations under the Contract.

Final selection by the SBC shall be the Most Qualified Proposer determined to be the most qualified responsible proposer for the Services after consideration of price and all factors necessary for faithful performance of the Services based on the criteria and scope of Services included in this RFQ/RFP.

The SBC reserves the right to negotiate with the most qualified responsible proposer and to accept modifications to the scope of the Services and/or fees proposed if such action would be in the best interests of the City and District.

Any Submission in response to this RFQ/RFP shall constitute a declaration by the submitting

Proposer that no person or persons other than members of Proposer’s own organization are interested in the Project or in the contract proposed to be awarded through this RFQ/RFP procurement process; that the Submission is made without any connection with any other person or persons making a proposal for the same Services and is in all respects fair and without collusion or fraud; that no persons acting for or employed by the SBC, City, District, or Ansonia

Board of Education are directly or indirectly interested therein, or in the supplies or works to which it relates or will receive any part of the profit or any commission therefrom in any manner which is unethical or contrary to the best interests of the City and District.
