About this file
This is a performance measures and liquidated damages exhibit (Exhibit B) for RLI 25004JD issued by the Broward County Sheriff's Office. The document establishes minimum performance standards and associated penalties for a contractor providing occupational health services including pre-employment medical exams, drug testing (pre-employment, random, and reasonable suspicion), hepatitis B vaccinations, fitness for duty examinations, and an online platform for managing these services. All services must comply with HIPAA, OSHA, and applicable federal, state, and local regulations, with specific turnaround times ranging from 2 hours for reasonable suspicion drug testing response to 5 working days for various medical exams and test results reporting.
The performance standards include strict timing requirements with 100% compliance expected across all service categories, and liquidated damages ranging from 25% discounts off individual services for timing failures to $50 per inaccurate invoice for billing errors. More significant penalties include 3-4% of service fees for inaccurate reports or regulatory non-compliance, and $500 per 0.1% downtime below 99% daily uptime for the online platform. Performance will be audited annually through statistically valid random sampling with a 95% confidence level and 3% deviation margin, conducted either by the Sheriff's Office personnel or an independent third-party auditor. The cost of annual audits will be shared equally between both parties, and liquidated damages become due within 30 days of written notification, payable either through invoice credits or direct payments to the Sheriff's Office.

EXHIBIT B | Performance Measures and Liquidated Damages | RLI 25004JD
EXHIBIT B - PERFORMANCE MEASURES AND LIQUIDATED DAMAGES
The PROPOSER must agree to the following minimum performance standards and applicable liquidated damages. At the
Broward County Sheriff’s Office discretion, an audit of the accuracy of the PROPOSER’s results will be performed via a randomly selected, statistically verifiable sample of claims by a qualified, independent third party. The results of the audit after appropriate review and comment by the PROPOSER will be the final determinant of performance standard compliance.
When sampling methods are used to estimate performance for the universe of PROPOSER’S delivered services, audit samples will be large enough to ensure a confidence interval whose deviation is no greater than plus or minus three percent
(3%) and whose confidence level is at least ninety-five percent (95%). The Broward County Sheriff’s Office will consider the point estimate for the sample as the PROPOSER’s performance level in calculating liquidated damages.
The Broward County Sheriff’s Office’s reserves the right to reduce or waive any liquidated damages if, in the Broward County
Sheriff’s Office’s sole discretion, failure to meet a performance standard was due to extraordinary circumstances.
