Traverse Ridge Retaining Wall Repair Contract Documents
This is a Request for Bids and associated contract documents issued by Draper City Corporation's Engineering Division for the Traverse Ridge Retaining Wall Repair Project. The project encompasses repair of two retaining walls along Traverse Ridge Road in Draper, Utah, including labor, materials, tools, and equipment necessary to complete all work according to project plans and specifications. The East Wall repair includes stormwater pollution prevention, traffic control, clearing and grubbing, debris removal, installation of 342 square feet of retaining wall blocks, 2,610 square feet of geogrid, 143.9 cubic yards of granular borrow, block sealing, chemical surface treatment, clay soil filling, and landscape restoration. The West Wall repair includes stormwater pollution prevention, traffic control, debris removal, concrete waterway removal and replacement, installation of 381 square feet of retaining wall blocks, chemical surface treatment, and landscape restoration. Electronic bid submissions through the Utah Public Procurement Place (U3P) are due by 2:00 p.m. on July 30, 2026, with questions accepted through 5:00 p.m. on July 28, 2026. All bids must be accompanied by a photocopy of a 5% bid bond payable to Draper City or an equivalent certified check. Upon award, contractors must provide performance and payment bonds, each in the amount of 100% of the contract price, along with certificates of insurance within ten calendar days of the Conditional Notice of Award. The contract price includes all costs for bonds, insurance, permits, fees, and required testing. Bid prices must include sales tax and all applicable taxes and fees. The contractor is responsible for obtaining all necessary building permits, as the walls are considered structural, though Draper's building department waives permit fees. No subcontractor may be awarded work exceeding 50% of the contract price without prior written approval from the City. The City retains the right to reject any and all bids and waive irregularities or informalities deemed in the city's best interest. The City is not responsible for expenses incurred by bidders prior to award by the City Council. Award of the contract will be based on the lowest responsible bidder, considering factors such as contractor experience, previous performance with the city, contract change orders, schedule adherence, workmanship quality, and any claims or legal issues.

B. SITE EXAMINATION
Bidders should carefully examine the drawings and specifications including addenda prior to the formal bid opening. Bidders should also visit the site of the work to become fully informed of all existing conditions and limitations. Any interpretation of the proposed documents will only be made by addenda duly issued and a copy of such addenda will be made available prior to bid opening to each plan holder.
C. REQUIRED BONDS
Bids must be accompanied by the photocopy of a bid bond payable to Draper City
(OWNER) for five percent of the total amount of the bid. An original copy of the bid bond will be requested from the lowest responsible bidder. When the contract is executed, and the OWNER receives the performance, payment, and all other required bonds, the bid bond of the successful bidder will be returned. A certified check made payable to OWNER may be used in place of the bid bond.
A performance and payment bond, each in the amount of 100 percent of the contract price, with a corporate surety approved by the owner, will be required to ensure faithful performance of the contract. The duration of the performance and payment bond shall be one year after the anticipated completion date of the project.
Attorneys-in-fact whom sign the bid bond and performance and payment bond must file with each bond a certified and effective dated copy of their power of attorney signed with original signatures or facsimile.
The party to whom the contract is awarded will be required to provide the performance, payment and all other required bonds (including certificates of insurance), within ten calendar days from the date when Notice of Award is delivered to the bidder.

If bidder fails to execute the contract, the owner may consider the bidder in default, in which case the bid bond accompanying the bid shall become property of the owner.
D. CONTRACT AWARD
It is the intent of Draper City to award the contract based upon the lowest and most responsible bidder provided that the bid has been submitted in accordance with the requirements stated in the solicitation documents. The experience and responsibility of the contractor will ultimately be a determining factor in the contract award.
Furthermore, a contractor's previous experience with the city, including but not limited to contract change orders, failure to meet deadlines, relationships with the public, workmanship and materials, and/or claims or legal issues, will also be included in the consideration of the lowest bid when awarding the contract.
E. NOTIFICATION
After formal award of the project, verification of the bonds, and execution of the agreement, the contractor will then receive the Notice to Proceed, which will establish the date that work will begin under the contract. The work on this Project shall commence within 10 days of receipt of the Notice to Proceed. The work shall be completed within a maximum of 60 calendar days of Notice to Proceed. All work stoppages due to inclement weather conditions and other factors must be verified by the Project Manager. Work stoppages due to equipment failure will not be the responsibility of Draper City. Failure to comply with the project schedule will result in liquidated damages as specified in the agreement.
F. SUBCONTRACTORS
The bid submittal shall include a list of subcontractors to be used on the project. This list shall be binding upon the contractor, however, Draper City has the right to reject any or all subcontractors listed which the City feels is unqualified to do the work.
