About this file

This is a GRAMA Business Confidentiality Claim form provided by the Utah State Archives, Office of the Government Records Ombudsman, in connection with the Traverse Ridge Retaining Wall Repair project solicitation by Draper City. The form is designed to allow bidders and contractors to claim confidentiality protection for trade secrets and commercial financial information submitted in response to the city's request for proposals. The project scope involves providing all labor, materials, tools, and equipment necessary to repair two retaining walls along Traverse Ridge Road according to project plans and specifications. Bid documents and specifications were posted to the Utah Public Procurement Place (U3P) website on or before Thursday, July 16, 2026, at 2:00 PM. Electronic responses were due to the Engineering Division by 2:00 PM on Thursday, July 30, 2026, with responses received after this deadline not accepted. Questions concerning the scope of work, response submittal, or process were to be directed electronically through U3P before 5:00 PM on Tuesday, July 28, 2026. Draper City reserves the right to reject any and all responses and to waive any irregularities or informalities.

The form requires claimants to submit both redacted and non-redacted versions of their proposals, with the Division of Purchasing declining to perform redactions on behalf of a claimant who fails to provide a redacted copy. A 5% Bid Bond is required with all responses. Under Utah Code 63G-2-305(1) and 63G-2-305(2), trade secrets and commercial financial information may be protected from public disclosure through GRAMA requests if the submitting party provides a confidentiality claim with a concise statement of reasons. However, making a confidentiality claim does not guarantee protected classification if the government receives a public records request. Responses are opened by Draper City staff and promptly posted to the U3P website within 24 hours, with preliminary bid results available in the project's Q & A section. The city is not responsible for any expenses incurred by bidders prior to contract award by the City Council.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
