Failure to employ sufficient workers to respond to the Owner’s needs be they emergent, planned or both simultaneously may be grounds for removal from the contract within the terms defined in the default section of the document.

The Contractor agrees and will abide that the County can and sometimes does require the Contractor to perform more than one project at a time. The Contractor shall be capable of providing sufficient qualified staff to carry out at least two projects at the same time. For purposes of defining project staffing requirements it is assumed each project shall entail minimally two employees per site but if more are required the Contractor is obliged and required to staff each as is required in order to complete the project in accordance with the time-frames allowed within the Owner’s work request and the Contractor’s response.

Failure to produce records within the specified timeframe may be considered a default and shall be treated as such under the terms and conditions intended for such failures to perform.

BILLABLE SERVICES

This contract is based on the unit-price of labor and materials and as such the County will only pay for time on-site while work is being performed and for the materials necessary thereto. Travel time to and from the workplace is not covered under the terms of this contract, nor is office time for billing permitted (other than the time allowed to prepare responses to work requests) as a billable service.

All cost for such un-billable work shall be absorbed within the hourly rate for on-site workers. The County will allow no more than two (2) hours at the rate of $75.00 per hour for the preparation of a work request response as a part of the duties of the Contractor. An immediate conference will take place between the Owner and the Contractor to determine cause and reschedule the work in order to avoid future unplanned/unannounced interruptions and/or final default.

The Contractor shall inform the facility staff of their arrival and departure and provide written record in the Owner supplied Contractor logbook of the date/time and their staff present to justify hourly billing. The Contractor will also advise in advance (72 hours minimum) as well of any planned interruptions in utilities required to complete scheduled work. Notice shall be provided by the Contractor to the facility where work is intended in advance of their work and if the Contractor fails to provide notice, and is delayed in gaining access or commencing the work, the time lost shall be absorbed by the Contractor for failing to provide proper notice. Likewise if the Owner is at cause for delaying access to the work after proper notice is provided the Owner shall pay the appropriate hourly rate(s) for time lost by the Contractor.
