About this file
This is a Terms of Use Agreement (TOUA) governing access to controlled information related to Sources Sought Notice N00024-26-R-6215, issued by NAVSEA (Naval Sea Systems Command).
The agreement establishes strict requirements for companies seeking access to UNCLASSIFIED documents designated as Controlled Unclassified Information (CUI) or For Official Use Only (FOUO). Information provided contains export-controlled items subject to the Arms Export Control Act and International Traffic in Arms Regulation (ITAR). Access is limited to direct employees of the requesting firm with appropriate security clearances and a valid need-to-know for direct involvement with the sources sought effort. Disclosure to foreign nationals is strictly prohibited regardless of clearance status. All information requires PMS435 approval for further dissemination, and unauthorized disclosure carries criminal penalties for both companies and individuals. To receive access, companies must submit a completed TOUA with recipient identification information, including business name, DUNS number, CAGE code, business and mailing addresses, facility clearance level, storage capability level, classified mailing address, classified mailing point of contact, and security manager contact. The agreement must be signed by both a Facility Security Officer and an authorized corporate representative with authority to bind the company. Completed TOUAs must be returned via email to eric.dieges.civ@us.navy.mil, jada.n.williams11.civ@us.navy.mil, and timothy.h.nguyen.civ@us.navy.mil. Companies must maintain detailed copy and destruction logs documenting all copies, distributions, and destruction dates. All provided materials must be destroyed no later than 30 days after the sources sought submission date using Government-approved methods, with destruction confirmation and logs provided to the Contracting Officer within seven days. Failure to maintain adequate protection of logs and records may result in termination of access.
