About this file

This document contains required affidavits for bidders, offerors, and contractors participating in state and local contract opportunities in Kentucky, specifically related to the City of Owensboro's request for proposals to provide rental and service of portable toilets for various City divisions. The affidavits establish compliance requirements under Kentucky Administrative Regulations and Kentucky Revised Statutes for entities seeking qualified bidder status or resident bidder status. Bidders claiming qualified bidder status must certify they meet the requirements outlined in 200 KAR 5:410(3) and will maintain compliance throughout any awarded contract term. Alternatively, bidders may claim status as a nonprofit corporation furthering the purposes of KRS Chapter 163 or as a qualified nonprofit agency for individuals with severe disabilities, which requires that the organization employ individuals with severe disabilities for at least seventy-five percent of direct labor man hours and maintain registration in good standing with the Secretary of State.

Bidders claiming resident bidder status must swear under penalty of perjury that, as of the contract advertisement date, they are authorized to transact business in Kentucky and have maintained Kentucky income tax filings, payments to the Kentucky unemployment insurance fund, and an active Kentucky workers' compensation policy for at least one year prior to and through the advertisement date. Both affidavits must be notarized and signed by the affiant. The bidding agency reserves the right to request documentation supporting any claimed status and may disqualify bidders or terminate contracts for failure to provide such documentation upon request.
