About this file

Exhibit D is a prevailing wage rate compliance document applicable to the West Ambulatory Surgery Center project for El Paso County Hospital District d/b/a University Medical Center of El Paso in Texas. This exhibit establishes the prevailing wage rate requirements and contractor compliance obligations for all tiers of work on the project subject to Texas Government Code Chapter 2258. The prevailing wage rates for the project are adopted by the Owner and issued with the solicitation package or by addendum. Contractors are required to pay each worker no less than the applicable prevailing wage rate for their respective classification of work performed throughout the duration of the project.

Contractors must maintain accurate time and payroll records identifying worker name, classification, hours worked, hourly rate, and applicable deductions, and are responsible for flowing down prevailing wage requirements to all subcontractors. Certified payroll records for the contractor and all subcontractors must be submitted as a condition of payment, at minimum monthly and with each pay application as required by the Owner, potentially in a standardized or electronic format designated by the Owner. The Owner reserves the right to review payroll records, conduct site interviews to verify compliance, and withhold progress payment amounts until compliance is verified. Any identified prevailing wage violations may result in corrective action requirements, including payroll corrections and worker restitution. All questions regarding prevailing wage requirements must be submitted in writing to the Point of Contact identified in the solicitation, as verbal guidance is not binding.
