The Contractor shall provide clean equipment for the project prior to driving on Forest and between project areas to prevent the introduction of invasive weeds to the Forest.
Avoidance and minimization measures:
1. Boundaries of crossing work areas will be clearly defined in the field. Upstream and downstream limits of disturbance on either side of a stream will be clearly marked in the field and reviewed by the project biologist prior to initiation of work. Areas of disturbance will be minimized as feasible.
2. Access to sites must be via pre-existing access routes to the greatest extent possible. If the use of a new access route is necessary, use will be approved by the project biologist prior to implementation. The extent of ground disturbance will be held to the minimum necessary to accomplish the job and restored to pre-project conditions when no longer needed.
3. The removal of existing willow or other woody riparian species will be minimized.
4. If needed, a Forest Service biologist will survey the project sites to determine the presence of listed species. If any species are found, work will be limited to between August 15th and January 31st.
5. To minimize potential effects to water quality and aquatic wildlife, work will occur during periods of low or no flow.
6. A water pollution control plan will be developed by the Forest Service or its contractors specifying details related to control of sediment and hazardous materials, dewatering or diversion structures, fueling and equipment management practices, and other factors deemed necessary by Forest Service engineers and resource specialists responsible for water quality and biological resource protection.
7. The Forest Service will coordinate with the Fish and Wildlife Service’s (Service) Condor Recovery
Program within one week prior to project implementation to determine if any California condors are known to be in the vicinity of the project area.
8. Trash and microtrash associated with the project will be removed on a daily basis during project implementation.
9. If a California Condor is seen landing within the project area all operations shall cease within 0.5 miles of the bird and the CO/COR shall be notified immediately.
10. All equipment used during maintenance and construction in this project should be cleaned prior to being used at the work site.
11. Ensure to the extent practicable, that road fill and gravel sources do not contain non-native invasive plant seeds.
12. Avoid placement of staging areas in non-native invasive plant infested areas.
13. Road maintenance activities will occur during the normal operating season from April 15 to
October 15 unless otherwise approved by the Contracting Officer or Contracting Officer’s Representative.
14. Rocking, straw mulch, hay bales, or waddles will be used as necessary, where the possibility of water spill or overflow would otherwise result in sediment being moved toward the creek.
15. No fueling or refueling of mechanical equipment will occur within 100 feet of any flowing watercourse or intermittent drainage.
16. Prior to the start of operations, the contractor shall prepare and provide in writing to the
Government a Spill Prevention Control and Countermeasures Plan detailing how fuel spills are to be prevented and addressed when total oil and oil products storage exceeds 1320 gallons in containers of 55 gallons or greater. The SPCP shall meet applicable EPA (40 CFR 112) and State requirements and be certified by a registered professional engineer. The contractor shall notify the CO of all reportable (40 CFR 110) spills on or in the vicinity of the contract area that are caused by Contractor operations.

Plan. The plan shall include, but is not limited to; listing any hazardous substances used on the project area and shall have Material Safety Data Sheets available for those materials. All such materials shall be labeled in accordance with Federal and State regulations and this information shall be supplied to the Government responsible for supervising initial containment action for releases and subsequent cleanup.
18. The Contractor shall maintain all equipment operating on the project area in good repair and free of leakage of lubricants, fuel, coolant and hydraulic fluid. The Contractor shall take effective measures to prevent all leaking or spilled petroleum based products from stationary equipment and equipment being serviced. Refueling and maintenance activities associated with equipment and machinery at landings shall be conducted within fuel containment basins capable of holding and containing any potential fuel spills emanating from refueling units, refueling cells or the machinery being refueled. The Contractor shall furnish oil-absorbing mats for use under all stationary equipment or equipment being serviced to prevent leaking or spilled petroleum-based products from contaminating soil and water resources.
19. The Contractor shall immediately notify appropriate agencies, including written notification to the
Government of all spills, leaks or other releases of hazardous materials including petroleum products on or in the vicinity of NFS land caused directly or indirectly by the Contractor or
Contractor’s employees. The Contractor shall immediately take action to contain and cleanup, without expense to the Government, all petroleum products spills caused directly or indirectly by the Contractor or Contractor’s employees. The Contractor shall properly transport and dispose of all contaminated soil, vegetation, debris, oil filters, oily rags, waste oil and any other materials in accordance with local, State and Federal regulations. Disposal of any such contaminated material on the National Forest is prohibited. 23. Install erosion control measures on incomplete roads prior to precipitation events or the start of the winter period and in accordance with approved water pollution (or erosion) control plan.
24. Do not leave project areas for the winter with remedial measures incomplete.
25. No Treatment Areas (NTA)/Avoidance Areas exist within the treatment units and project area. No entry is permitted in the NTA’s. The NTA’s for this project are too small to be mapped but will be flagged and identified on the ground by Forest Service Archeologist for the contractor prior to operations in those areas.
26. Within 15 days of the notice to proceed and prior to the commencement of the work, the
Contractor will meet in conference with representatives of the Contracting Officer, at a time to be determined by the Government, to discuss and develop mutual understanding relative to scheduling and administering work
27. Cultural resource surveys have been conducted within the contract treatment units. All identified areas of concern have been recorded and are incorporated into the Special Treatment
Areas. A Forest Service Archeologist will flag and identify the areas of concern prior to the project implementation. The Contractor is solely responsible for avoiding impacts to these, or any other control areas within the project units. During the performance of work under this contract, if previously unidentified archeological or historic sites are encountered, the Contractor shall discontinue work in the general area of the suspected site and contact the Government immediately. Work shall be suspended in that area until proper surveys have been completed by the Government.
28. Trash associated with this project will be removed and properly disposed of. A forest wildlife biologist or designee will brief all personnel involved in implementing the project on the importance of not leaving hazardous materials exposed and daily removal of all garbage fragments to maintain condor health.
