About this file

This is a Domestic Partnership Act Certification form for Broward County, Florida, applicable to the Well Column Pipes procurement opportunity. The certification form must be completed and submitted by vendors responding to solicitations valued over $100,000. Vendors are required to certify their compliance status with Broward County's Domestic Partnership Act (Sections 16-150 through 16-165, Broward County Code of Ordinances), which mandates that contractors provide benefits to registered domestic partners of employees on the same basis as benefits provided to employees' spouses. The form requires vendors to indicate one of four compliance statuses: current compliance, commitment to comply at contract award, non-compliance, or eligibility for an exemption. For responsiveness requirements, the completed form must be submitted with the initial vendor submittal or within three business days of the County's request; failure to comply results in vendor non-responsiveness. For tiebreaker consideration, vendors must submit the form at the time of solicitation submittal to remain eligible.

The form identifies five categories of exemptions from the Domestic Partnership Act requirements: vendors employing fewer than five employees, vendors that do not provide spousal benefits, governmental entities and non-profit organizations, religious organizations and charitable institutions, and vendors providing cash equivalents of benefits. Additionally, vendors may claim exemption if compliance would violate federal or state law or conflict with terms of a federal or state grant or contract, with submission of supporting legal documentation required. The certification must be signed by an authorized vendor representative and includes fields for vendor name, signatory printed name and title, and date of certification. The form date is September 9, 2024.
