About this file
This is a Domestic Partnership Act Certification form for Broward County, Florida, applicable to vendors contracting with the County for goods and services valued over $100,000. The certification requires vendors to acknowledge their awareness of Broward County's Domestic Partnership Act (Sections 16-150 through 16-165, Broward County Code of Ordinances) and declare their compliance status regarding the provision of benefits to registered domestic partners of employees on the same basis as spousal benefits. Vendors must complete and submit this form either with their initial solicitation response or within three business days of the County's request; failure to comply with submission deadlines may render the vendor nonresponsive to the solicitation or ineligible for the Domestic Partnership tiebreaker advantage. The form requires vendors to select one of four primary certification options: current compliance with the Act, commitment to comply at contract award, non-compliance, or qualification for one of six specified exemptions.
Vendors may claim exemptions from the Domestic Partnership Act requirements if they employ fewer than five employees, do not provide spousal benefits, operate as governmental entities or recognized non-profit or religious organizations, provide cash equivalents in lieu of benefits (with required affidavit documentation), or demonstrate that compliance would violate applicable federal or state law or grant/contract conditions with the United States or State of Florida. The form was issued on September 9, 2024, and applies to the Complex Coordinated Terrorist Attack Full Scale Exercise solicitation for Broward County's Office of Emergency Management. Vendors must provide their legal entity name, authorized signature, printed name, title, and date of certification on the completed form.
