Contract Documents Summary – 2026 700 West Improvements Project

This is a Request for Bids issued by Draper City Corporation Engineering Division in Utah for the 2026 700 West Improvements Project. The project scope encompasses installation of storm drain infrastructure, curb and gutter, sidewalk, new half-width asphalt pavement, and miscellaneous items along 700 West from approximately 11500 S to 11800 S. Bid documents will be posted to the Utah Public Procurement Place (U3P) on or before May 28, 2026, at 2:00 PM. Electronic bid responses must be submitted through U3P by 2:00 PM on June 11, 2026, with late submissions not accepted. Bid results will be posted within 24 hours showing only bidder names and total bid amounts. Questions must be submitted electronically through U3P by 2:00 PM on June 9, 2026. No pre-bid conference has been scheduled. The contract award will be made to the lowest and most responsible bidder, with consideration given to contractor experience, previous performance with the city, and adherence to deadlines. A strict deadline of June 25, 2026, exists for signing and notarizing the construction agreement.

Bids must include a 5 percent bid bond payable to Draper City, with performance and payment bonds each required at 100 percent of the contract price with corporate surety approval. The contract duration includes a maximum of 120 calendar days from Notice to Proceed for project completion, with liquidated damages assessed at $2,000 per day for late completion. All work stoppages due to inclement weather and utility/power pole relocations will not count toward contracted working days; however, work stoppages due to equipment failure remain the contractor's responsibility. The bid schedule includes 34 line items with unit prices or lump sums for labor, materials, tools, equipment, and testing. Significant project considerations include right-of-way acquisition across three parcels at 11750 S and 11790 S that may delay work, relocation of Rocky Mountain Power poles, Google Fiber infrastructure relocation, utility potholing investigations, and tree trimming. The City will provide one-time construction staking at its expense through Sunrise Engineering, with any additional staking paid by the contractor. The contractor must obtain permits for impacts to neighboring jurisdictions and is responsible for quality control material testing, traffic control implementation, and completing a Storm Water Pollution Prevention Plan within five calendar days of award.

✓ Submission Deadline: 2:00 PM on THURSDAY, JUNE 11TH, 2026

✓ Bids received after the deadline will not be considered.

✓ Bids will be opened electronically and the names of the bidders responding to the Request for Bids will be available online immediately thereafter. Bids and Bid

Bonds will then be checked by the Engineer.

B. SITE EXAMINATION

Bidders should carefully examine the drawings and specifications including addenda prior to the formal bid opening. Bidders should also visit the site of the work to become fully informed of all existing conditions and limitations. Any interpretation of the proposed documents will only be made by addenda duly issued and a copy of such addenda will be made available prior to bid opening to each plan holder.

C. REQUIRED BONDS

Bids must be accompanied by the photocopy of a bid bond payable to Draper City

(OWNER) for five percent of the total amount of the bid. An original copy of the bid bond will be requested from the lowest responsible bidder. When the contract is executed, and the OWNER receives the performance, payment, and all other required bonds, the bid bond of the successful bidder will be returned. A certified check made payable to OWNER may be used in place of the bid bond.

A performance and payment bond, each in the amount of 100 percent of the contract price, with a corporate surety approved by the owner, will be required to ensure faithful performance of the contract. The duration of the performance and payment bond shall be one year after the anticipated completion date of the project.

Attorneys-in-fact whom sign the bid bond and performance and payment bond must file with each bond a certified and effective dated copy of their power of attorney signed with original signatures or facsimile.

The party to whom the contract is awarded will be required to provide the performance, payment and all other required bonds (including certificates of insurance), within ten calendar days from the date when Notice of Award is delivered to the bidder.

The party to who the contract is awarded will be required to execute the agreement within ten calendar days from the date when the Construction Agreement is delivered to the bidder. If bidder fails to execute the contract, the owner may consider the bidder in default, in which case the bid bond accompanying the bid shall become property of the owner.

D. CONTRACT AWARD

It is the intent of Draper City to award the contract based upon the lowest and most responsible bidder provided that the bid has been submitted in accordance with the requirements stated in the solicitation documents. The experience and responsibility of the contractor will ultimately be a determining factor in the contract award.

Furthermore, a contractor's previous experience with the city, including but not limited to contract change orders, failure to meet deadlines, relationships with the public, workmanship and materials, and/or claims or legal issues, will also be included in the consideration of the lowest bid when awarding the contract.

E. NOTIFICATION

After formal award of the project, verification of the bonds, and execution of the agreement, the contractor will then receive the Notice to Proceed, which will establish the date that work will begin under the contract. The work on this Project shall commence within 10 days of receipt of the Notice to Proceed. The work shall be completed within a maximum of 120 calendar days of Notice to Proceed. All work stoppages due to inclement weather conditions and other factors must be verified by the Project Manager. Work stoppages due to equipment failure will not be the responsibility of Draper City. Failure to comply with the project schedule will result in liquidated damages as specified in the agreement.

F. SUBCONTRACTORS

The bid submittal shall include a list of subcontractors to be used on the project. This list shall be binding upon the contractor, however, Draper City has the right to reject any or all subcontractors listed which the City feels is unqualified to do the work.

ADDITIONAL INSTRUCTIONS TO BIDDERS

1. CONSTRUCTION AGREEMENT DEADLINE: This project relies on funding with a strict deadline in order to proceed. A construction agreement must be signed and notarized by the contractor by June 25th, 2026. Failure to post the necessary bonds and sign the contract by this date may result in the contractor losing the awarding of the work associated with this project.

2. Right-of-Way Acquisition: This project requires acquisition of new right-of-way across 3 parcels. The addresses of these parcels are 11750 S (two parcels) and 11790 S (one parcel). This process has begun, but we do not have a date by which these properties will be acquired. By bidding on this project, the contractor understands that this land must be acquired before work in the area can begin. Delays associated with or caused directly by this acquisition process will not count towards the allotted contract working days agreed to for this project. Unit costs bid on this project should include costs or fees associated with initial mobilization, and a potential re-mobilization to complete work in the ROW acquisition area.

3. Power Pole Relocation: Rocky Mountain Power (RMP) has been notified regarding the needed relocation of a minimum of two poles on the north end of the project. RMP or their assigned contractor(s) will be relocating these poles. Delays associated with or caused directly by this relocation effort will not count towards the contracted working days.

4. Google Fiber / Other Communications: Google Fiber has been notified regarding the needed relocation of their lines and several hand hole boxes along the project. Google Fiber or their assigned contractor(s) will be relocating this infrastructure. Delays associated with or caused directly by this relocation effort will not count towards the contracted working days. Other communications companies may be contacted regarding their infrastructure as well, with the same notes and requirements previously discussed.

5. Potholing. Utility investigations (pot-holing) and the costs associated with it are to be included in the bid unit costs. These are to be conducted at utility crossings of the new storm drain alignment and must be expedited in order to notify utilities of necessary loops or relocations.

6. Interpretation of Specifications. If the intent or meaning of the technical specifications is unclear or requires further clarification and/or additional information please submit a written request for information by fax or email.

Specifications have been updated from the previous published version.

7. Quality Assurance - Material Testing. In Section 01820, “Material Testing”, Part 1.03 B, of the Standard Specifications, the City chooses to perform the

Construction and Facilities" in the specifications will not apply to this project. However, no road closures will be allowed for this project. And a traffic control plan and flagging operation during day-time work as appropriate must be approved by the Inspector.

11. Project Dates and Liquidated Damages. Liquidated Damages for late completion are $2,000 per day.

12. Structures to Finish Grade. No payments for tons of hot mix asphalt will be made until all utility structures, within the limits of the area where the requested tonnage of hot mix asphalt was placed, are raised to grade per Section 02438, “Structures to Finish Grade’, of the Standard

Specifications. Storm drain manhole collars are to be square.

13. Pavement Striping and Marking. All striping and pavement marking identified on the plans and as directed by the Engineer shall be applied twice at the application rates called out in Section 02577, “Pavement

Marking – At Grade”, Part 3.02 D of the Standard Specifications.

14. Google Fiber. There is Google Fiber present. Depths to the fiber line cannot be confirmed. Google has been notified in advance of this work.

15. Tree Trimming. Tree trimming will likely be required as part of this project.

The residents are to be given adequate advance notice to have the option (and given direction on how) to trim the trees themselves.

Otherwise, these costs are to be included in the unit costs for the project.

If not completed by the residents, trimming is the responsibility of the contractor in anticipation of milling and paving efforts. Tree trimming must meet Draper City Specifications.

16. Construction Staking. Construction staking will be provided by Sunrise

Engineering, one time, at the City’s expense. After the one-time staking is performed, any additional staking requested will be paid for by the

Contractor. The Engineer will coordinate with the contractor to order the one time construction staking as it becomes necessary.
