About this file
This is a Claim of Business Confidentiality form submitted in conjunction with an RFSQ for Architectural Services for a High School Gym Addition at Timpanogos High School, issued by the Alpine School District Department of Purchasing and conducted by Timpanogos School District Professional Services. The form allows vendors to assert claims of business confidentiality for sensitive information submitted as part of their qualifications, in accordance with Utah Code Annotated Sections 63G-2-305 and 63G-2-309. Vendors may protect non-public financial statements, specific employee names and contact information, customer or client lists, and other proprietary information by specifying the page, paragraph, and reason for protection on the form.
The form explicitly prohibits vendors from classifying pricing or cost proposals as confidential, as these will be considered public information, and prevents the classification of entire proposals as protected or proprietary. Claims of confidentiality must be based on information qualifying as trade secrets or commercial information that could result in unfair competitive injury if disclosed. Vendors asserting confidentiality claims will be notified if records are classified as public or if the governmental entity determines release is appropriate after weighing competing interests under applicable Utah Code provisions.
