About this file

This is a Confidential and Proprietary Information Declaration Form for the Government Records Access and Management Act (GRAMA) business confidentiality claim, submitted to Salt Lake City Corporation Purchasing & Contracts Management Division in connection with the Request for Bid SLCI26078 for Parts & Service for Small Engine Repair. The form serves as a template for contractors or private providers to identify protected records or information they wish to shield from public disclosure under Utah Code provisions 63G-2-305 and 63G-2-309. Contractors completing this form must provide their company information, identify the specific pages and paragraphs of submitted documentation that contain confidential material, and include a concise statement of reasons supporting the confidentiality claim. The form permits claimants to indicate whether a redacted public copy of the records is also being provided.

The confidentiality claim under Utah law applies specifically to trade secrets and commercial financial information that could reasonably result in unfair competitive injury if disclosed. Submission of a confidentiality claim does not guarantee protected classification status, as the governmental entity retains discretion in determining whether information qualifies for protection. Contractors must submit the completed declaration form along with the information they seek to protect to be considered for confidential treatment. This document is blank and awaiting completion by a bidder or contractor responding to the small engine repair parts and service solicitation.

Business Request for GRAMA Business Confidentiality Claim For use by contractors or private providers to identify protected records or information

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected.
