About this file
This is a Confidential and Proprietary Information Declaration Form for the Government Records Access and Management Act (GRAMA) business confidentiality claim process, issued by Salt Lake City Corporation Purchasing & Contracts Management Division in connection with the RFP SLCI26080 for Privacy Consulting Services. The form enables contractors and private providers to identify protected records or information that qualify for confidential classification under Utah Code provisions. Specifically, the form allows claimants to protect trade secrets and commercial financial information from public disclosure if such disclosure could reasonably result in unfair competitive injury. The declaration requires submission of a concise statement of reasons supporting the confidentiality claim, submitted simultaneously with the information being protected. Claimants must complete all required fields including company information, contact details, and specific identification of the records requiring protection by page, paragraph, and reason for each confidentiality claim.
The form serves as a protective mechanism for sensitive business information submitted during the procurement process, though execution of a confidentiality claim does not guarantee protected classification if the government receives a subsequent public records request. Contractors must indicate whether a public redacted copy of the records is also being provided and may submit multiple confidentiality claims for different sections of documentation. The confidentiality claim framework is established under Utah Code Sections 63G-2-305 and 63G-2-309, which define qualifying protected records and claim procedures. This form is essential for any bidder on the Privacy Consulting Services contract who wishes to protect proprietary, trade secret, or sensitive commercial information from disclosure during the evaluation and selection process.

Business Request for GRAMA Business Confidentiality Claim For use by contractors or private providers to identify protected records or information
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected.
