About this file
This document is a Business Request for GRAMA (Government Records Access and Management Act) Business Confidentiality Claim form issued by the Utah State Archives' Office of the Government Records Ombudsman. The form is designed to help businesses protect trade secrets and commercial financial information from public disclosure under Utah Code § 63G-2-305. The form requires companies submitting confidential information to a governmental entity to provide a detailed confidentiality claim, including a concise statement of reasons for protecting specific information.
Key requirements include submitting both a redacted and non-redacted version of the proposal, with the entire proposal not being eligible for complete redaction. The claimant must specify which pages, paragraphs, and reasons support the confidentiality claim. The document emphasizes that making a confidentiality claim does not guarantee protected classification if the government receives a records request. Companies must carefully document their reasons for claiming confidentiality and understand that the Division of Purchasing will not redact proposals on behalf of claimants who fail to upload a properly redacted copy.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
