About this file
The document is a Business Request for GRAMA (Government Records Access and Management Act) Business Confidentiality Claim form issued by the Utah State Archives and the Office of the Government Records Ombudsman. The form is designed to help businesses protect trade secrets and commercial financial information from public disclosure under Utah Code § 63G-2-305. The form requires companies to submit both a redacted and non-redacted version of their proposal, with a specific section for explaining the reasons for confidentiality.
The form emphasizes that submitting a confidentiality claim does not guarantee protection, and the Division of Purchasing will not redact proposals on behalf of claimants who fail to upload a redacted copy. The document provides spaces for company information, contact details, and a section for specifying which pages, paragraphs, and reasons warrant confidential treatment. Claimants must provide a concise statement supporting their confidentiality claim and understand that the government may still disclose information if a records request is received.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
