About this file

This file is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with the State of Utah Division of Purchasing's Request for Statements of Qualifications (RFSQ) for contract JH27-121, a Zeedyk-Structure Contractor project for Goslin Creek restoration. The project, conducted by the State of Utah Division of Wildlife Resources, seeks a full-service design and implementation contractor to install up to 60 Zeedyk-style in-stream structures to support restoration of a wet-meadow area on Goslin Mountain. The contract will be awarded under Administrative Rule R33-105 for Small Purchases of Professional Service Providers and Consultants, with a small purchase threshold of $100,000.00. Bidders are instructed not to include pricing in their statements of qualifications submissions.

The form enables contractors to claim protection of trade secrets and commercially sensitive financial information under Utah Code 63G-2-305, requiring claimants to provide a concise statement of reasons supporting confidentiality protection and submit both redacted and non-redacted versions of their proposals. The Division of Purchasing will not perform redactions on behalf of claimants who fail to submit a redacted copy. The confidentiality claim does not guarantee protected classification if the government receives a public records request under the Government Records Access and Management Act (GRAMA). Claimants must provide complete company and representative information, identify specific pages and paragraphs subject to confidentiality claims, and detail the reasons for each claim.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
