About this file

This is a Claim of Business Confidentiality document submitted to the Utah Division of Purchasing by the conducting procurement unit for the MD27-1 Helicopter Hoist Overhaul contract. The document supports the state's notice of intent to award a contract without competition, asserting that only one source exists for the helicopter hoist overhaul procurement item. The claim designates specific information within the submission as confidential business information, protecting proprietary details regarding the sole source justification and supporting documentation that establishes the unique capability or necessity for awarding to a single vendor without engaging in standard competitive procurement procedures under the Utah Procurement Code.

The confidentiality claim restricts public disclosure of commercially sensitive information submitted by the conducting procurement unit to justify the single-source award determination. This protective measure allows the state to maintain the competitive advantage and proprietary knowledge of the vendor while proceeding with the non-competitive contract award, provided the Division of Purchasing makes a written determination that the single-source justification meets statutory requirements. The document serves as a procedural safeguard ensuring that sensitive business and technical information related to the helicopter hoist overhaul services remains confidential during the procurement evaluation process.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
