About this file

This document is a GRAMA (Government Records Access and Management Act) Business Confidentiality Claim form from the Utah State Archives, Office of the Government Records Ombudsman, applicable to the Tooele County Ballot Printing and Mailing Services contract opportunity. The form provides the mechanism by which vendors submitting proposals can claim protection for trade secrets and commercial financial information under Utah Code sections 63G-2-305 and 63G-2-309. Vendors responding to the Tooele County RFP for comprehensive election ballot printing, ballot packet assembly, envelope printing, mailing, and related election material services may utilize this form to request confidential treatment of sensitive business information included in their proposals. The contract opportunity involves a single award to the responsive and responsible vendor with the highest score, with an initial term of one year plus up to four additional option years, and vendors must guarantee pricing for sixty days.

The confidentiality claim process requires claimants to submit both redacted and non-redacted versions of their proposals, with the form requiring detailed information about the company, the specific records or pages for which confidentiality is claimed, and a concise statement of reasons supporting the claim. The document emphasizes that the Division of Purchasing will not perform redactions on behalf of vendors and that submission of a confidentiality claim does not guarantee protected classification if the government receives a public records request. This form is essential for vendors seeking to protect proprietary business information, pricing strategies, or trade secrets from disclosure under Utah's public records law while still participating in the competitive procurement process.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
