About this file

This is a Claim of Business Confidentiality filing related to a Request for Statements of Qualifications (RFSQ) issued by the State of Utah Division of Purchasing on behalf of the Governor's Office of Economic Development. The procurement seeks a qualified vendor to maintain, support, and scale a customized, mobile-responsive B2B e-learning platform powered by the Braeze software system. The contract is structured as a one-year initial term with four optional one-year renewal periods, allowing for up to five years of potential engagement. This is a Design Professional Service Providers and Consultants procurement conducted under Utah Procurement Code 63G-6a Part 15. The vendor submission with the highest ranking will be selected to enter into contract negotiations with the state at compensation rates to be determined as fair and reasonable.

The business confidentiality claim indicates that certain proprietary or sensitive information has been submitted by a vendor and marked as confidential in their response to the RFSQ. Vendors are explicitly instructed not to include pricing information in their qualifications submissions, as compensation will be negotiated separately with the highest-ranked vendor following selection. If the state cannot reach agreement on fair and reasonable compensation, contract requirements, or contract documents with the top-ranked vendor, the procurement may proceed to negotiate with the next highest-ranked vendor. No pricing terms, set-asides, incumbent information, or specific funding amounts are detailed in this confidentiality claim document.

A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted.
