About this file

This document is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman, applicable to state procurement processes under the Utah Procurement Code. The form is designed to allow vendors and contractors submitting proposals to the Division of Purchasing to assert confidentiality protections for trade secrets and commercial financial information in accordance with Utah Code sections 63G-2-305 and 63G-2-309. The claimant must submit both redacted and non-redacted versions of their proposal, with the form requiring detailed information about the company, the specific pages and paragraphs subject to confidentiality claims, and a concise written statement of reasons supporting the claim. The Division of Purchasing will not redact proposals on behalf of claimants who fail to provide a properly redacted copy.

The confidentiality claim process applies specifically to procurement submissions to governmental entities and does not guarantee protected classification if a Government Records Access and Management Act (GRAMA) records request is received. Claimants must complete all required fields including company name, address, representative contact information, governmental entity name, and date of submission. The form allows for multiple confidentiality claims across different pages and paragraphs, with each claim requiring a distinct reason for protection. This form serves as a protective mechanism for vendors participating in state and local contract opportunities, enabling them to shield proprietary and sensitive business information from public disclosure while maintaining transparency in the procurement process.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
