About this file

This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman, applicable to the Division of Purchasing's procurement process for the Department of Public Safety's National Law Enforcement Telecommunication System funding increase. The form serves as a mechanism for vendors and contractors to protect trade secrets and commercial financial information from public disclosure under Utah's Government Records Access and Management Act (GRAMA). Claimants seeking confidentiality protection must submit both redacted and non-redacted versions of their proposals, provide detailed justification for their confidentiality claims, and include specific information about which pages and paragraphs contain protected material along with the reasons for protection.

The claim process requires submission of claimant information including company name, address, contact details, and the governmental entity receiving the submission. While filing a confidentiality claim does not guarantee that information will receive protected classification if a public records request is received, the claim must be submitted contemporaneously with the information being protected. The form explicitly prohibits the Division of Purchasing from redacting proposals on behalf of claimants who fail to submit their own redacted versions, placing responsibility on the submitting party to identify and justify all requested confidentiality protections in accordance with Utah Code sections 63G-2-305 and 63G-2-309.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
