About this file

This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in conjunction with an insurance licensing examination services request for proposal from the Utah Insurance Department. The RFP seeks a single vendor to provide facilities, equipment, and processing services to administer license examinations, acquire and transmit candidate fingerprints, and transmit examination results and license application information to the Department's current data processing vendor, Vertafore. The contract term is five years, with the vendor required to guarantee pricing throughout the entire contract period.

The confidentiality claim form is a standardized document that allows bidders to protect trade secrets and commercial financial information from public disclosure under Utah's Government Records Access and Management Act (GRAMA). Claimants must submit both redacted and non-redacted versions of their proposals, provide specific reasons for confidentiality claims by page and paragraph, and include company representative contact information. The form notes that submission of a confidentiality claim does not guarantee protected classification if the government receives subsequent records requests, and that the Division of Purchasing will not redact proposals on behalf of claimants who fail to provide properly redacted versions.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
