About this file

This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with Contract 246183 Amendment 3, a funds increase procurement by the State of Utah's Division of Purchasing. The form serves as a template for contractors and vendors to submit claims for protection of trade secrets and commercial financial information under Utah Code 63G-2-305 and 63G-2-309. Claimants must provide a concise statement of reasons supporting their confidentiality claim and submit both redacted and non-redacted versions of their proposals; failure to provide a redacted version will result in the Division of Purchasing declining to perform redactions on behalf of the claimant.

The form requires claimants to provide detailed company information including name, address, representative contact details, and to specify which pages and paragraphs of their submission are subject to the confidentiality claim along with the corresponding reasons for protection. Claimants must understand that submission of a confidentiality claim does not guarantee protected classification if the government receives a records request, as determinations are made on a case-by-case basis by the appropriate governmental entity. The entire proposal cannot be redacted, ensuring that public access to government procurement records is maintained while protecting legitimate proprietary interests.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
