About this file
This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with a Video Production Services contract opportunity administered by the State of Utah Division of Purchasing on behalf of the Department of Cultural & Community Engagement (CCE) and its nine divisions. The form provides the framework for vendors submitting qualifications to protect trade secrets and commercial financial information from public disclosure under Utah's Government Records Access and Management Act (GRAMA). Vendors responding to the RFSQ for video production services must submit both redacted and non-redacted versions of their proposals if they wish to claim confidentiality protections; failure to submit a redacted copy will result in the Division of Purchasing declining to redact the proposal on the vendor's behalf. The contract opportunity is for a 5-year term with compensation to be negotiated following selection of the highest-ranked vendor.
The confidentiality claim form requires vendors to provide detailed information about their company, identify specific pages and paragraphs subject to confidentiality protection, and include a concise written statement explaining the basis for each claim. Claimants must demonstrate that the information constitutes trade secrets as defined under Utah Code 63G-2-305(1) or commercial financial information that could reasonably result in unfair competitive injury if disclosed under Utah Code 63G-2-305(2). The form emphasizes that submission of a confidentiality claim does not guarantee protected classification if the government receives a GRAMA records request, placing the burden on vendors to properly document and substantiate their claims for protection of sensitive business information.

Office of the Government Records Ombudsman Utah State Archives
Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
