About this file

This is a Business Confidentiality Claim Form submitted to the Utah State Archives' Office of the Government Records Ombudsman for the State of Utah Division of Purchasing's Request for Proposal (RFP) to procure bulk order dairy products (excluding milk). The form is designed to allow vendors to assert claims for protecting trade secrets and commercial financial information in their proposal submissions under Utah Code 63G-2-305 and 63G-2-309. Vendors submitting confidentiality claims must provide both redacted and non-redacted versions of their proposals, with the understanding that only specific portions of the proposal may be protected from public disclosure. The RFP is structured to potentially result in multiple awards, with contracts having a five-year term and an administrative fee of 0.75 percent.

The evaluation methodology requires vendors to meet all mandatory minimum requirements to advance to technical evaluation, score at least 455 of 700 available points (65 percent) in the technical evaluation to proceed to cost evaluation, and achieve a combined score of at least 650 of 1,000 total points to be awarded a contract. Vendors must guarantee pricing for three months. The confidentiality claim form itself does not specify pricing terms, set-asides, or funding amounts, but rather serves as the mechanism by which vendors can protect proprietary information contained within their proposals from disclosure under Utah's Government Records Access and Management (GRAMA) Act.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
